RESOLUTION NO. 95-176 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR A REZONE OF A PORTION OF THE NE'Ia OF SECTION 27, TOWNSHIP 18 NORTH, RANGE 22 WEST, FROM A-R (AGRIcUL TURAL.RESIDENTIAL) AND c-2 (GENERAL COMMERCIAL) ZONES TO C. RE (COMMERCIAL-RECREATION) ZONE IN THE SOUTH MOHAVE VALLEY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on May I, 1995, a public hearing was conducted to determine whether approval should be granted for an Extension of Time for a Rezone for the above described property as requested by Gem Land Company of Phoenix, Arizona, being represented by Stovall Engineers of Bullhead City, Arizona, and WHEREAS, the site is located eight miles south of Bullhead City and west of Highway 95. The parcel is accessed directly from Highway 95, then west on King Street, and WHEREAS, the original rezone request for this site was approved by the Mohave County Board of Supervisors on January 3,1994 via BOS Resolution No. 94-5, and WHEREAS, at the present time, the golf course has been constructed and is in use; however, not all of the conditions ofBOS Resolution No. 94-5 have been met. The remaining conditions of Resolution No. 94-5 that still need to be met are a parcel plat/site plan, drainage report, documentation from the authority of the pipeline easement and the necessary ADOT permits for access from Highway 95 as indicated by Exhibit "A" of Resolution No. 94-5, and WHEREAS, initially on February 17, 1995, the Zoning Manager sent a letter to Stovall Engineers notifYing them of noncompliance to all the conditions of Resolution No, 94-5. An Extension of Time was requested by Stovall Engineers in a letter dated February 27, 1995. In the letter Stovall Engineers states "due to illness of the previous engineer, Stovall Engineers, Inc. has been retained to complete the project. The owner/developer was not aware of the conditions or expirations until February 17, 1995, in a letter that was received from Tom Aragon, Zoning Manager", and WHEREAS, this will be the first Extension of Time. This extension was not applied for until March 1995, two months after the original rezone had expired. Planning staff considers a six-month extension more than enough time for the developer to submit the necessary items in order to comply with Resolution No. 94-5, and . - . . y RESOLUTION NO. 95-176 Page 2 PAGE :2 OF 2 6K 2~62 PG B09 (FEE.9~-230+0) WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on April 12, 1995, the Commission recommended APPROVAL for an Extension of Time for a Rezone subject to the following: 1. Continued compliance with all the conditions ofBOS Resolution No. 94-5. 2. This Extension of Time will be in effect until August 4, 1995. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, April 16, 1995, and posted April 14, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, May 1, 1995, APPROVED this Extension of Time for a Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
