A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR THE APPROVED
PRELIMINARY SUBDIVISION PLAN FOR EMERALD RIVER ESTATES, TRACT 4093, BEING
A PORTION OF THE NY, OF THE NEv.., SECTION 25, TOWNSHIP 19 NORTH, RANGE 22
WEST, LOCATED IN THE SOUTHMOHA VE VALLEY AREA, MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on Monday,
May 1, 1995, a public hearing was conducted to determine whether approval should be granted for an
Extension of Time to Gordon Hanshaw, President, Emerald River Development, Inc., for the above
described Preliminary Subdivision Plan. The engineer of record for the subdivision is Stadler Consulting
Engineers, Inc. of Phoenix, Arizona, and
WHEREAS, the subdivision is located east of Highway 95 and south ofEl Rodeo Road, and
WHEREAS, the Preliminary Plan depicts 32 plus acres subdivided into 107 single-family lots,
ranging in size form 9,585 square feet to 16,700 square feet, and
WHEREAS, Phase I of this subdivision has been recorded, and a number of homes have been built.
The original plan was approved based on the use of individual septic systems. These individual systems are
no longer viable for the subdivision, and sewer will need to be provided to the second phase, and
WHEREAS, the Mohave County Public Works Department has indicated that there are some
drainage issues that need to be resolved in connection to the drainage control structure on the west side of
the subdivision, and
WHEREAS, the owner has indicated in a letter dated March 7, 1995, "We are currently talking with
Stephen Valihora, who is president of Sun Valley Airport and Angelo Rinaldi from Sorenson (utilities), who
are also interested in the possibility of connecting to sewer. Tract 4093 is ready to proceed with the
exception of sewer or septic. We have made all necessary improvements, such as gas, electric, water,
telephone, cable and paving. All improvements were made with the understanding that ADEQ would
approve our map. Due to the problems we have been experiencing with ADEQ, sewer systems seem to be
the only viable alternative to septic systems.", and
WHEREAS, the Preliminary Plan for this tract was approved by the Mohave County Board of
Supervisors on March 5, 1990, per BOS Resolution No. 90-58. The first Extension of Time was granted
on January 4, 1993, per BOS Resolution No. 93-4. The second Extension of Time was granted on
September 6, 1994, per BOS Resolution No. 94-201. Article 3.10-1 states, "Upon application to the
Commission and prior to the expiration, of the time limit, extensions in increments of one (1) year may be
granted by the Board if the subdivider is actively processing the Final Plat. If such action is not taken then
all proceedings relating to the plat shall be terminated.", and

WHEREAS, this will be the third Extension of Time, and
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
April 12, 1995, the Commission recommended APPROVAL for an Extension of Time subject to the
following:
I. Compliance with all conditions ofBOS Resolution Nos. 90-58, 93-4, and 94-201.
2. The drainage control structure located on the west portion of the property has failed for the
second time. This structure was constructed with Phase A; however, it acts to control runoff
emanating for Phase B of this development. As a condition of this Extension of Time and
recording of the Final Plat, the developer is required to take immediate steps to design and
construct adequate measures to control this runoff.
3. This Extension of Time will be in effect until March 5,1996.
WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Arizona, Mohave County, Arizona, April 16, 1995 and posted on April 14,
1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on May 1, 1995, APPROVED this Extension of Time as recommended by the Mohave County Planning and
Zoning Commission and outlined herein.
