PAGE 1 OF 2 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDI~G FEE 0.00 He MlCROFlLMED f)~ .~~ RESOLUTION NO. 95-245 A RESOLUTION SETTING FORTH A REZONE OF GATEWAY ACRES, TRACT NO.9, LOT 119, IN SECTION 9, TOWNSHIP 25 NORTH, RANGE 19 WEST, FROM A (GENERAL) ZONE TO A-R/IA (AGRIcULTURAL.RESIDENTIAL/ONE ACRE MINIMUM LOT SIZE) ZONE, IN THE MORAVE COUNTY GENERAL AREA, MORAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on June 5, 1995, a public hearing was conducted to determine whether approval should be granted for a Rezone for the above described property as requested by Joe and Judith Mapalo of Bloomington, California being represented by C.S.N.A. Surveying, and WHEREAS, this property is located east of Highway 93 and north of Pierce Ferry Road. This site is accessed from Highway 93 north on Pierce Ferry Road to Cedar Road, then north on Cedar Road to Seventh Street, then east on Seventh Street to Chloride Drive, then north on Chloride Drive to the site. The site is located on the east side of Chloride Drive, and WHEREAS, the site is vacant and flat, sloping slightly to the west. There are no washes or significant drainage that cross the property. There are two residences to the north and four to the southwest of the site. The remaining property is vacant, and WHEREAS, the property owner proposes to split the five acres into four one-plus-acre parcels. There are several splits in the area. Previous splits in the south half have taken the parcels down to one-plus- acre lots, and WHEREAS, review of FEMA FIRM Panel #040058-1775B indicates that this parcel lies within Zone C, not in FEMA Special Flood Hazard Area. A Floodplain Use Permit is not required, and WHEREAS, the Public Works Department recommends the denial of this rezone based upon the inadequate potential for roadway infrastructure to justify increasing the density of this area, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on May 10, 1995, the Commission recommended APPROVAL for a Rezone subject to the following: 1. These parcels will be rezoned A-R/1A (Agricultural-Residential/One Acre Minimum Lot Size). 2. The submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications and Details is required. .. .... That the Board of Supervisors accepts the granting of the north 20 feet as an ingress and egress and public utilities ea~ement (I&E and PUE) on the northern boundary of this parcel. In addition, 20-foot radius curves are required at all dedicated roadway intersection points. 4. The grantings required by the rezone resolution shall be shown on the Parcel Plat and accepted by the Board of Supervisors upon Parcel Plat recordation. 5. Each parcel shall meet or exceed its respective acreage exclusive of roadways. 6. Each parcel shall have legal access. 7. The Parcel Plat shall show any surface drainage and FEMA flood zones. 8. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. 9. The rezone shall not become effective for 30 days after final Board of Supervisors approval for the change in classification, as per ARS 11-829E. 10. If these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to granl an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title II, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, May 21, 1995, and posted May 19, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, June 5, 1995, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
