RESOLUTION NO. 95-244 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON LAKE MOHA VE COMMERCIAL CENTER, LOT 14, IN SECTION 2, TOWNSHIP 25 NORTH, RANGE 19 WEST, FOR BULK PROPANE SALES IN A c-2 (GENERAL COMMERCIAL) ZONE, IN THE MORAVE COUNTY GENERAL AREA, MORAVE COUNTY, ARlZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on June 5, 1995, a public hearing was conducted to determine whether approval should be granted for a Zoning Use Permit for the above described property as requested by Star Auction, Appraisal & Country Store, Inc., being represented by Susan A. Pojmanski of Dolan Springs, Arizona, and WHEREAS, the applicant proposes to sell propane at her place of business. The site is located east of Highway 93 and south of Pierce Ferry Road in the Lake Mohave Commercial Center. The site is accessed from Highway 93 via Pierce Ferry Road to the site. The property is on the south side of Pierce Ferry Road, and WHEREAS, the property is relatively flat and has two structures on the property. The surrounding land uses consist of other small businesses and residences to the southeast, and WHEREAS, review ofFEMA FIRM Panel #040058-1800C indicates this parcel to be in Zone C, not in the FEMA Special Flood Hazard Area. A Floodplain Use Permit is not required, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on May 10, 1995, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: 1. The applicant shall comply with all applicable state and fire marshal requirements. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits. 3. The appropriate zoning, building, environmental and floodplain permits will be obtained. 4. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety and welfare. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, May 21, 1995, and posted May 19, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, June 5, 1995, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
