RANCHES NO.2, TORO ACRES, LOT 28, IN SECTION 19, TOWNSHIP 23 NORTH, RANGE 16 WEST, FROM A-R/IOA (AGRIcULTURAL-RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE TO A.R/SA (AGRICULTURAL-RESIDENTIAL/FIVE ACRE MINIMUM LOT SIZE) ZONE, IN THE MORA VE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on June 5, 1995, a public hearing was conducted to determine whether approval should be granted for a Rezone for the above described property as requested by James Helwig of Golden Valley, Arizona, and WHEREAS, the property is located north of Kingman, Arizona, east of Stockton Hill Road between Calle Caliente and Calle Charcas Roads. This property is accessed from Stockton Hill Road east on Calle Chavez to A venida Ramirez, then south on A venida Ramirez to Calle Caliente, then east on Calle Caliente to A venida Mendez, then south on A venida Mendez to Calle Charcas, then west on Calle Charcas to the site. The site is located on the north side of Calle Charcas, and WHEREAS, the site is vacant and lies on a hill that rises sharply toward the northwest. There are no washes or significant drainage crossing the property. The surrounding property is vacant, and WHEREAS, the property owner proposes to split the 16.57 acres into three five-acre parcels. There are several splits in the area including the adjacent lot. Previous splits have reduced lots to approximately five acres in size. The approved General Plan designates this to be a suburban area, and WHEREAS, review of FEMA FIRM Panel #040058-2155B indicates that this parcel lies within Zone C, not in FEMA Special Flood Hazard Area. A Floodplain Use Permit is not required, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on May 10, 1995, the Commission recommended APPROVAL for a Rezone subject to the following: 1. These parcels will be rezoned A-R/5A (Agricultural-ResidentiallFive Acre Minimum Lot Size). 2. The submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications and Details is required. That the Board of Supervisors accepts the granting of a 40-foot roadway and public utility easement, complete with a 45-foot radius cul-de-sac terminus to be named Dedo Plazuela. In addition, a 20-foot radius curve is required at the intersection point of the roadway easement and road right-of-way. 4. The grantings required by the rezone resolution shall be shown on the Parcel Plat and accepted by the Board of Supervisors upon Parcel Plat recordation. 5. Each parcel shall meet or exceed its respective acreage exclusive of roadways. 6. Each parcel shall have legal access. 7. The Parcel Plat shall show any surface drainage and FEMA flood zones. 8. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. 9. The rezone shall not become effective for 30 days after final Board of Supervisors approval for the change in classification, as per ARS 11-829E. 10. If these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title II, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, May 21,1995, and posted May 19, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
