PAGE 1 Of 3 nOHAVE COUNTY BOARD OF SUPERVISORS RECORDI~G fEE 0.00 NC RESOLUTION NO. 95-238 A RESOLUTION SETTING FORTH A REZONE OF PARCEL 315, IN THE SW1A NWIA OF SECTION 20, TOWNSHIP 21 NORTH, RANGE 18 WEST, FROM A-R/I0A (AGRICULTURAL- RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE TO A-R/5A (AGRICULTURAL- RESIDENTIAL/FIVE ACRE MINIMUM LOT SIZE) ZONE, IN THE GOLDEN VALLEY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on June 5, 1995, a public hearing was conducted to determine whether approval should be granted for a Rezone for the above described property as requested by Paul and Pauline Defrancisco and Robert and Grace Colosi of Hawthorne Woods, Illinois being represented by C.S.N .A. Surveying of Kingman, Arizona, and WHEREAS, the property is located south of Highway 68 between Colorado Road on the west side, Hassayampa Road on the east side, Rainwater Drive on the north side and Diabase Drive on the south side. This property is accessed from Highway 68 via south on Colorado Road to the site. The site is on the east side of Colorado Road, and WHEREAS, the site is vacant and relatively flat, sloping slightly to the southeast. There are not any washes or significant drainage crossing the property. There is a mobile home to the northwest and several mobile homes to the south of this property. There is a water tank and a small electrical transformer station on the southwest corner and power lines running along the north side of this property, and WHEREAS, the property owners propose to split the original 4O-acre parcel into four 5-acre parcels fronting onto Colorado Road, and one 20-acre parcel between Rainwater and Diabase Drives fronting onto Hassayampa Road. There are several other splits in the area. Previous splits have taken parcels down to 5 acres. The approved General Plan designates this to be an urban area, and WHEREAS, review ofFEMA FIRM Panel #040058-2325B indicates this parcel to be in Zone A, in the FEMA Special flood Hazard Area. A Floodplain Use Permit is required for any development, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on May 10, 1995, the Commission recommended APPROVAL for a Rezone subject to the following: I. The four parcels fronting on Colorado Road will be rezoned A-R/5A (Agricultural- ResidentialIFive Acre Minimum Lot Size) and the zoning for the remaining 20-acre parcel fronting on Hassayampa Road will remain A-R/IOA (Agricultural-Residential/Ten Acre Minimum Lot Size). . . The submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications and Details is required. 3. That the Board of Supervisors accepts the dedication of the existing 50-foot roadway easements known as Rainwater Drive, Diabase Drive, Hassayampa Road and Colorado Road located respectively along the north, south, east and west boundaries of this property as road rights-of-way. In addition, a 20-foot radius curve is required at all dedicated roadway intersection points. 4. That the Board of Supervisors accepts the granting of an eight-foot public utilities easement (PUE) adjacent to the roadway dedications. 5. The dedications and grantings required by the rezone resolution shall be shown on the Parcel Plat and accepted by the Board of Supervisors upon Parcel Plat recordation. 6. Each parcel shall meet or exceed its respective acreage exclusive of roadways. 7. Each parcel shall have legal access. 8. The Parcel Plat shall show any surface drainage and FEMA flood zones. 9. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. 10. The rezone shall not become effective for 30 days after final Board of Supervisors approval for the change in classification, as per ARS 11-829E. II. If these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, I J -832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, May 21, 1995, and posted May 19, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. . . NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, June 5, 1995, APPROVED t,his Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
