RESOLUTION NO. 95-237
A RESOLUTION SETTING FORTH A REZONE OF THE SEVi OF PARCEL 116, IN THE SEVi
NEVi OF SECTION 13, TOWNSHIP 21 NORTH, RANGE 18 WEST, FROM A-R/IOA
(AGRlCULTURAL-RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE TO A-R/4A
(AGRlCULTURAL-RESIDENTIAL/FOUR ACRE MINIMUM LOT SIZE) ZONE IN THE
GOLDEN V ALLEY AREA, MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on June 5,
1995, a public hearing was conducted to determine whether approval should be granted for a Rezone for the
above described property as requested by Gary D. and Dorothy Vertz, Jr., of Golden Valley, Arizona being
represented by R. W. Holmquist & Associates, and
WHEREAS, the property is located south of Highway 68 between Bowie and Tooman Roads. This
property is accessed from Highway 68 via south on Bowie Road to Abrigo Drive, then east on Abrigo Drive
to the site. The property is located on the northwest corner of Tooman Road and Abrigo Drive, and
WHEREAS, the site has gently rolling terrain rising toward the northeast and there are no washes
or significant drainage crossing the property. There is one double-wide mobile home on the property. There
are a few scattered residences to the north, south, and west of the site. BLM land is on the east side, and
WHEREAS, the property owner proposes to split the nine-plus (net) acres into two 4.4-plus-acre
parcels. There are several splits in the area taking parcels down to 2.5 acres. The approved General Plan
designates this to be an urban area, and
WHEREAS, review ofFEMA FIRM Panel #040058-2325B indicates that this parcel lies within
Zone C, not in FEMA Special Flood Hazard Area. A Floodplain Use Permit is not required, and
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
May 10, 1995, the Commission recommended APPROVAL for a Rezone subject to the following:
I. These parcels will be rezoned A-R/4A (Agricultural-Residential/Four Acre Minimum Lot
Size).
2. The submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of
the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications
and Details is required.

3. That the Board of Supervisors accepts the dedication of the 30-foot roadway easement on the
south side of the property as a road right-of-way known as Abrigo Drive. In addition, a 20-
foot radius curve is required at the intersection of Abrigo Drive and Tooman Road.
4. That the Board of Supervisors accepts the granting of an eight-foot public utilities easement
(PUE) adjacent to Tooman Road and Abrigo Drive.
5. The dedications and grantings required by the rezone resolution shall be shown on the Parcel
Plat and accepted by the Board of Supervisors upon Parcel Plat recordation,
6. Each parcel shall meet or exceed its respective acreage exclusive of roadways.
7. Each parcel shall have legal access.
8. The Parcel Plat shall show any surface drainage and FEMA flood zones.
9. The appropriate zoning, building, environmental and floodplain permits will be obtained
prior to any development. These permits will not be issued until Parcel Plat recordation.
10. The rezone shall not become effective for 30 days after final Board of Supervisors approval
for the change in classification, as per ARS ll-829E.
II. If these conditions are not met within one year this approval will be void. If at the expiration
of this period the property has not been improved to meet the use for which it was
conditionally approved, the Board (after notification by registered mail to the owner and
applicant who requested the rezoning) shall schedule a public hearing to grant an extension,
determine compliance with the schedule for development, or cause the property to revert to
its former zoning classification. This action is in accordance with Arizona Revised Statutes
Annotated, Title II, Chapter 6, 11-832.
MOHA VE COUNTY BOARD OF SUPERVISORS
WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County, Arizona, May 21, 1995, and posted May 19, 1995, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
