IN THE GOLDEN VALLEY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on June 5, 1995, a public hearing was conducted to determine whether approval should be granted for a Rezone for the above described property as requested by Harold C. and Betty L. Carl of Sioux Falls, South Dakota, and WHEREAS, the property is located north of Highway 68, between Egar and Estrella Roads. This land is accessed from Highway 68 via north on Egar Road to Chinle Drive, then east on Chinle Drive to Eden Road, then south on Eden Road to the site. The property is located on the east side of Eden Road, and WHEREAS, the site is flat, sloping slightly to the east, and has one mobile home on the site. There are no washes or significant drainage crossing the property. There are a couple of residences to the south of this site, and the remaining property is vacant, and WHEREAS, the property owner proposes to split the 2.35-acre parcel into two equal parcels. All the lots in Section 27 were originally 2.35-plus-acres. There have been several splits in the area. Previous splits have taken the parcels down to one-plus-acre in size. The approved General Plan designates this to be a suburban area, and WHEREAS, review ofFEMA FIRM Panel #040058-2l25C indicates that this parcel lies within Zone C, not in FEMA Special Flood Hazard Area. A Floodplain Use Permit is not required, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on May 10. 1995, the Commission recommended APPROVAL for a Rezone subject to the following: I. These parcels will be zoned A-R/IA (Agricultural-Residential/One Acre Minimum Lot Size). 2. The submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications and Details is required. 3. Each parcel shall meet or exceed its respective acreage exclusive of roadways. . . . . RESOLUTION NO. 95-235 Page 2 4. PAGE 2 OF 2 BK 2577 PG 5t5 (FEE~95-29308) Each parcel shall have legal access. 5. The Parcel Plat shall show any surface drainage and FEMA flood zones. 6. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. 7. The rezone shall not become effective for 30 days after final Board of Supervisors approval for the change in classification, as per ARS 11-829E. 8. If these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title II, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, May 21, 1995, and posted May 19, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, June 5, 1995, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
