SECTION 36, TOWNSHIP 19 NORTH, RANGE 22 WEST, TO BE KNOWN AND SUBDIVIDED AS DESERT LAKES ESTATES, TRACT 4152, FROM A-R (AGRICULTURAL-RESIDENTIAL) TO R-O (SINGLE- FAMILY RESIDENTIAL HOMES ONLY), LOCATED IN THE SOUTH MOHAVE VALLEY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on Monday, June 5, 1995, a public hearing was conducted to determine whether approval should be granted for a Rezone for the above described property. The owner of this tract is Desert Lakes II, Limited Partnership of Fort Mojave, Arizona. The engineer responsible for the preparation of the drainage report and design of this subdivision is Stadler Consulting Engineers of Gilbert, Arizona, and WHEREAS, the property is located on the east of Mountain View Road between Joy Lane and Lipan Boulevard, and WHEREAS, the subdivision will consist of 80-plus acres subdivided into 272 residential lots and a number of drainage parcels. The residential lots range in size from 8,000 to 9,260 square feet, and WHEREAS, this parcel ofland was conditionally rezoned on August 6, 1990, per BaS Resolution No. 90-197 to SD/R (Special-Development/Residential); however, this zoning was approved for single- family homes and multiple-family units, and WHEREAS, the electric power will be provided by Mohave Electric Cooperative, telephone will be provided by Citizens Utilities Company, sewage treatment by Sorenson Sanitary District, solid waste disposal by Tri-State Refuse Disposal, water by Bermuda Water Company, and fire protection from the Fort Mojave Mesa Fire Department, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on May 10, 1995, the Commission recommended APPROVAL for a Rezone subject to the following: I. The lots be zoned R-O (Single-Family Residential Homes Only). 2. The appropriate zoning, building, environmental and floodplain permits will be obtained. 3. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. . .,......... - ... . . RESOLUTION NO. 95-226 Page 2 PAGE :1 OF 2 BK 2577 PG 527 (F~Et95-29299) 4. The rezone will become effective upon recordation of the Final Plat for Desert Lakes Estates, Tract 4152. If the development is phased, the zoning for the recorded phase only will become effective. MOHA VE COUNTY BOARD OF SUPERVISORS 5. The lot size minimum will be based on the size of the lots recorded on the Final Plat with no further lot splits. 6. The rezone shall not become effective until 30 days after final approval of the change in classification by the Board of Supervisors, as per ARS 11-829E. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, May 21,1995 and posted on May 19, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on June 5, 1995, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
