MlCROALMED .DEXEO RESOLUTION NO. 95-223 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR REZONING OF RIO PALMAS, UNIT 1, FIRST AMENDED, LOTS 11 AND 12, IN SECTION 14, TOWNSHIP 19 NORTH, RANGE 22 WEST, FROM A-R (AGRICULTVRAL-RESIDENTIAL) ZONE TO C-MO/IA (COMMERCIAL-MANUFACTURING OPEN LOT STORAGE/ONE ACRE MINIMUM LOT SIZE) ZONE, IN THE SOUTH MOHA VE VALLEY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on August 7, 1995, a public hearing was conducted to determine whether approval should be granted for an Extension of Time for a Rezone for the above described property as requested by Jack Ehrhardt of Bullhead City, Arizona, and WHEREAS, the property is located south of the Bullhead City Limits, west of Highway 95 and south of Sterling Road. This property is accessed from Highway 95 west on Sterling Road. The site is located on the south side of Sterling Road, and WHEREAS, this zone change was conditionally approved by the Mohave County Board of Supervisors on May 4, 1992 via BaS Resolution No. 92-134. It was extended for the first time with BaS Resolution No. 94-256 on August 8,1994, and WHEREAS, this Extension of Time will allow the applicant "enough time to clean up the problems of financing and site layout", as stated in their undated letter, and the other conditions as required by BaS Resolution Nos. 92-134 and 94-256, and WHEREAS, the applicant has been in contact with El Paso Natural Gas Company about their possible addition of another gas line along Sterling Road West. This new line would_run down Sterling Road West and be on the south side of the existing gas line. They have not made a final decision at this time. This new route would require them to acquire a right-of-way easement through the applicant's two- acre site and cause considerable elevation change, as well as affect any new road work that would be done on Sterling Road. The applicant has been in contact with Richard Meyers, Superintendent, Topock Main Line District, and WHEREAS, on June 26, 1995, Mr. Meyers stated that a decision has not been made by EI Paso Natural Gas Company but a decision is forthcoming soon, and WHEREAS, the staff believes this is reason enough to grant another Extension of Time to allow the applicant time to accomplish the conditions as required by BaS Resolution Nos. 92-134 and 94-256, and to allow the gas company to clear up the right-of-way problems. The requirements of the new Extension of Time policy have been met, and RESOLUTION NO. 95-223 PAGE 2 ' OF 2 BK 2605 F'G 263 FEE~9504123 rage 2 ~_. . . WHEREAS, this will be the second Extension of Time for this property, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect on the property are in concurrence with the Mohave County General Plan and the property is in a designated Urban Area. c. The site of the parcel is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The proposal is to develop a builders' mart with four (4) buildings and a small amount of open lot storage of construction equipment. e. The neighboring area contains other like land uses similar to the above proposed action. f. A review ofFEMA FIRM Panel #040058-2435D indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area. A Floodplain Use Permit is not required. g. The site has legal access. h. There are no significant environmental features or problems affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on July 12, 1995, the Commission recommended APPROVAL for an Extension of Time for a Rezone subject to the following: 1. Continued compliance with the conditions of BaS Resolution No. 92-134. 2. The requirements of the new Extension of Time policy have been met. 3. This Extension of Time will be in effect until May 4, 1996. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, July 23, 1995, and posted July 21, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
