PAGE i OF 2 MO~AVE COUNTY SOARD OF SUPERVISORS RECORDING FEE 0,00 HC RESOLUTION NO. 95-221 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR THE APPROVED PRELIMINARY SUBDIVISION PLAN FOR TOPOCK SPRINGS ESTATES, TRACT 4125, BEING A SUBDIVISION OF THE NW'Ia OF SECTION 23, TOWNSHIP 16 NORTH, RANGE 21 WEST, LOCATED IN THE SOUTH MOHA VE VALLEY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on Monday, June 5, 1995, a public hearing was conducted to determine whether approval should be granted for an Extension of Time to J. William Jordan of Kingman, Arizona, for the above described Preliminary Subdivision Plan. The engineer of record for the subdivision is A-N West Inc. Consulting Engineers of Phoenix, Arizona, and WHEREAS, the subdivision is located south of the Golden Shores area on the west side of Oatman Highway, and WHEREAS, the Preliminary Plan depicts 82 acres subdivided into six parcels which will include a travel trailer park, multiple-family, and commercial land uses. The developer proposes several linear parks as greenbelt areas for open spaces and recreation, and WHEREAS, in a letter dated March 27,1995, from Glenn H. Shearer, A-N West Inc., the owner's representative requests an Extension of Time noting the following information: "Since the original date of approval of this Preliminary Plan was in April, we are submitting this request now and respectfully request and Extension of Time. Over the past year we had been authorized by the Jorden Trust to evaluate both waste water and water issues within the proposed subdivision and the surrounding area. We met with the Arizona Department of Environmental Quality, the Department of Water Resources and the U.S. Army Corp of Engineers (404 Permit)", and WHEREAS, an outline has been submitted by the engineer listing a summary of the meetings and outlining the key issues associated with the development. This includes a meeting with Arizona Department of Environmental Quality regarding Sanitary Districts, waste water issues and permits (Aquifer Protection Permit, National Pollution Discharge Elimination System Permits), a meeting with the Arizona Department of Water Resources regarding water issues, and a meeting with the Corps of Engineers, and RESOLUTION NO. 95-221 Page 2 . - . . PAGE 2 OF 2 BK 2~77 PG 521 (FEE*95-2929b) WHEREAS, the Preliminary Plan for this tract was approved by the Mohave County Board of Supervisors on April 2, 1991, per BaS Resolution No. 91-93. The first Extension of Time was granted on May 3,1993, per BaS Resolution No. 93-118; the second Extension of Time was granted on September 6, 1994, per BOS Resolution No. 94-203. Article 3.10-1 states, "Upon application to the commission and prior to the expiration of the time limit, extensions in increments of one (I) year may be granted by the Board if the subdivider is actively processing the final Plat. If such action is not taken then all proceedings relating to the plat shall be terminated", and WHEREAS, this will be the third Extension of Time, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on May 10, 1995, the Commission recommended APPROVAL for an Extension of Time subject to the following: 1. Compliance with all conditions of BaS Resolution Nos. 91-93, 93-118, 94-203. 2. This Extension of Time will be in effect until April 2, 1996. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, May 21, 1995 and posted on May 19, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on June 5, 1995, APPROVED this Extension of Time as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
