A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR THE APPROVED
PRELIMINARY SUBDIVISION PLAN FOR VISTA LAGUNA COUNTRY CLUB ESTATES,
TRACT 3038, BEING A SUBDIVISION OF SECTION 20 AND A PORTION OF THE SWv. OF
SECTION 21, TOWNSHIP 14 NORTH, RANGE 20 WEST LOCATED IN THE LAKE HA V ASU
CITY AREA, MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on Monday,
June 5, 1995, a public hearing was conducted to determine whether approval should be granted for an
Extension of Time to Lawrence E. Wilk, Jaburg & Wilk, P.C., representing James C. Sell, for the above
described Preliminary Subdivision Plan. The engineer of record for the subdivision is Southwest Civil
Engineering, Inc. of Lake Havasu City, Arizona, and
WHEREAS, the subdivision is located north of Lake Havasu City and west of London Bridge Road.
The Preliminary Plan depicts 290 acres subdivided into seven parcels including 297 single-family lots, 895
multiple-family dwelling units, and one commercial lot. The proposed zoning for the development is
SD/RO, C-2, and C-RE. Proposed land uses include an 18-hole golf course, driving and putting range, club
house with restaurant, visitors' center, motel and an RV storage area, and
WHEREAS, a letter dated FeblUary 27, 1995, from the owner's representative, requesting an
Extension of Time, noted the following information: "On November 8,1994, James C. Sell receiver for
Avanti Associates First Mortgage Fund 85 Limited Partnership, as the lienholder on the above-referenced
property, foreclosed its interest in the property and obtained title thereto. The owner is currently negotiating
to attempt to sell the property. It is anticipated that this sale will be consummated shortly. It is anticipated
that the site development will be prepared and submitted to the County within the next 90 days, and will
comply with the conditions of approval. The buyer should be providing you with a copy of the commitment
letter for the project's financing, and a letter from the subdivider for Southwest Civil Engineering to act as
agent processing this request", and
WHEREAS, John Finn, the individual purchasing the land, has submitted a copy of a Promissory
Note regarding financing of the project. He has indicated that he is working with the engineer of the project
to move forward with the submittal of the Final Plat. Staff has met with the owner and the engineer
regarding the project. The owner has proposed some minor changes to the approved Preliminary Plan and
will submit a Revised Preliminary Plan for review and approval, and

WHEREAS, the Preliminary Plan for this tract was approved by the Mohave County Board of
Supervisors on April 15, 1991, per BaS Resolution No. 91-92. The first Extension of Time was granted
on April 5,1993, per BaS Resolution No. 93-77; the second Extension of Time was granted on May 2,
1994, per BaS Resolution No. 94-135. Article 3.10-1 states, "Upon application to the commission and prior
to the expiration of the time limit, extensions in increments of one (I) year may be granted by the Board if
the subdivider is actively processing the Final Plat. If such action is not taken then all proceedings relating
to the plat shall be terminated", and
WHEREAS, this will be the third Extension of Time, and
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
May 10, 1995, the Commission recommended APPROVAL for an Extension of Time subject to the
following:
1. Compliance with all conditions of BaS Resolution Nos. 91-92, 93-77, and 94-135.
2. This Extension of Time will be in effect until April 15, 1996.
WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County, Arizona, May 21,1995 and posted on May 19, 1995, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on June 5, 1995, APPROVED this Extension of Time as recommended by the Mohave County Planning and
Zoning Commission and outlined herein.
