A RESOLUTION SETTING FORTH AN AMENDMENT TO BOS RESOLUTION NO. 94-443
WHICH APPROVED A REZONE OF PARCEL 2, AS SHOWN IN BOOK 4, PAGE 22 OF PARCEL
PLATS, SECTION 7, TOWNSHIP 20 NORTH, RANGE 17 WEST, FROM A-R (AGRICULTURAL-
RESIDENTIAL) TO C-2H (GENERAL-COMMERCIAL/HIGHW A Y FRONTAGE), LOCATED IN
THE MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA.
WHEREAS, at the special meeting of the Mohave County Board of Supervisors held on Monday,
May 15, 1995, a public hearing was conducted to determine whether approval should be granted for an
Amendment to BaS Resolution No. 94-443 which approved a Rezone for the above described property to
Dunton, Dunton and Sim of Kingman, Arizona, and McKee Foods Corporation of Collegedale, Tennessee,
and
WHEREAS, the original request for the rezoning of this property was for Parcel 2 only. This parcel
is not adequate for the intent of the McKee food distribution center. An additional parcel of land adjacent
to Parcel K was rezoned separately for the purpose of changing the general layout of the parcel of land that
will be developed by McKee. This amendment will allow changes that will better fit with the proposed
Parcel Plat that will be recorded for this parcel. All new language will be bolded and old language will be

WHEREAS, the property is located approximately four miles southwest of the Kingman city limits.
This land is accessed from Interstate Highway 40 via the Oatman Road off-ramp to Oatman Road, then
northeast to the site, and
WHEREAS, the property is flat with a gently rising slope from the southwest to the northwest.
There are residences to the west and south of the property. Roadway, a commercial truck terminal, is
adjacent to this parcel on the east and has a six-foot view-obscuring fence dividing the properties, and
WHEREAS, this site is within the limits of the McConnico Area Plan; the designation given for this
specific area is Urban (Commercial/Industrial), and
WHEREAS, review ofFEMA Floodplain Map #040058-2325B indicates this parcel is within Zone
C, an area of minimal flooding, and
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
May 10, 1995,

1. The southwest parcel and the reservoir/well site parcel will be zoned C-2H (General-
Commercial Highway Frontage), the southeastern parcel be zoned C-2HI2A (General-
Commercial Highway Frontage/Two Acre Minimum Lot Size) and the western parcel be
zoned C-2HI7A (General-Commercial Highway Frontage/Seven Acre Minimum Lot Size).
2. Submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the
Mohave County Subdivision Regulations, and 102.04-B of the Standard Specifications.
3. The applicant comply with all applicable provisions of the Mohave County Zoning
Regulations, compliance with Section 27.P (Site Plan Requirements), and a drainage report.
4. A Right-of-Way Encroachment Permit will need to be obtained from Mohave County for the
method of connecting the plant access road to Oatman Road.
5. A six-foot high block wall shall be erected along the west and north boundaries boundary of
the parcel to buffer the site from residential areas.

I'lVl''':! Iy. The Board of Supervisors accepts the dedication of a 40-foot Drainage and
Utility Parcel on the north side of Parcel 2 and that portion that aligns with Parcel J.
This Parcel will be known as Parcel JJ.
7. The granting dedication required by the rezone resolution shall be shown on the Parcel Plat
and accepted by the Board of Supervisors upon Parcel Plat recordation.
8. Each parcel shall have legal access.
9. The Parcel Plat shall show any surface drainage and FEMA flood zones.
10. That appropriate zoning, building, environmental and floodplain permits be obtained prior
to any development. These permits will not be issued until Parcel Plat recordation.
II. The rezone shall not become effective for 30 days after final Board of Supervisors approval
for the change in classification, as per ARS 11-829E.
12. If these conditions are not met within one year, this approval will be void. If at the expiration
of this period this property has not been improved to meet the use for which it was
conditionally approved, the Board (after notification by registered mail to the owner and
applicant who requested the rezoning) shall schedule a public hearing to grant an extension.

13. The northeast parcel is currently a reservoir/well site and will be designated for that
purpose. This information is to be noted on the Parcel Plat.
WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Arizona, Mohave County, Arizona, April 30, 1995 and posted on April 28,
1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their special meeting
on May 15, 1995, APPROVED this amendment of a Resolution for a Rezone as recommended by the
Mohave County Planning and Zoning Commission and outlined herein.
