"~'~ "'-''', >;:~ , ' . ~ .,~./ RESOLUTION NO. 95-208 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR THE APPROVED PRELIMINARY SUBDIVISION PLAN AND PETITION OF EXCEPTION FOR WILLOW VALLEY ESTATES 20, TRACT 4134, BEING A PORTION OF SECTION 21, TOWNSHIP 18 NORTH, RANGE 22 WEST, LOCATED IN THE SOUTH MOHA VE VALLEY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on Monday, May I, 1995, a public hearing was conducted to determine whether approval should be granted for an Extension of Time to McKellips Land Corporation for the above described Preliminary Subdivision Plan. The engineer of record for the subdivision is Stovall Engineers, Inc. of Bullhead City, Arizona, and WHEREAS, the subdivision is located west of Highway 95 and north of King Street, and WHEREAS, the Preliminary Plan depicts 22 acres subdivided into 80 single-family lots, a well site parcel and a number of open space parcels, and WHEREAS, in a letter dated February 27, 1995, from the owner's representative, an Extension of Time was requested as follows: "The Preliminary Plan approval for Willow Valley Estates, Unit 20 expired in March of 1994. The previous Engineer of Record became ill and was unable to complete the project. Stovall Engineers, Inc. has been retained to represent the owner/developer in order to process the next phase of the subdivision. We realize that, although the approval has expired, the Planning and Zoning Commission can consider such cases under extenuating circumstances. Construction on improvements has already begun, and undergrounds will be going in on December 1.", and WHEREAS, the Preliminary Plan for this tract was approved by the Mohave County Board of Supervisors on March 9,1992, per BaS Resolution No. 92-67. The first Extension of Time was granted on February 6, 1995, per BaS Resolution No. 95-33. Article 3.10-1 states, "Upon application to the commission and prior to the expiration, of the time limit, extensions in increments of one (I) year may be granted by the Board if the subdivider is actively processing the Pinal Plat. If such action is not taken then all proceedings relating to the plat shall be terminated.", and WHEREAS, this will be the second Extension of Time, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on April 12, 1995, the Commission recommended APPROVAL for an Extension of Time subject to the following: . . , RESOLUTION NO. 95-208 Page 2 , PAGE 2 Of 2 BK 2562 PG 866 (FEE~95-23068) I. Compliance with all conditions of BaS Resolution Nos. 92-67 and 95-33. 2. This Extension of Time will be in effect until March 9, 1996. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Arizona, Mohave County, Arizona, April 16, 1995 and posted on April 14, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on May I, 1995, APPROVED this Extension of Time as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
