RESOLUTION NO. 95-298
A RESOLUTION SETTING FORTH A REZONE OF J BAR H RANCHES, THE E% OF PARCEL
7, IN THE SE'A SE'A OF SECTION 9, TOWNSHIP 22 NORTH, RANGE 15 WEST, FROM A-R/I0A
(AGRICULTURAL-RESIDENTIALffEN ACRE MINIMUM LOT SIZE) ZONE TO A-R/5A
(AGRICULTURAL-RESIDENTIALIFIVE ACRE MINIMUM LOT SIZE) ZONE, IN THE
MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on July 5,
1995, a public hearing was conducted to determine whether approval should be granted for a Rezone for the
above described property as requested by Lawrence J, and Vera Keenan of Kingman, Arizona being
represented by C.S.N,A Surveying of Kingman, Arizona, and
WHEREAS, the property is located north of Kingman and east of Highway 66. This property is
accessed from Highway 66 through the Kingman Airport via northeast on Shipping Lane to Bruce Drive,
then north on Bruce Drive to Topeka Street along the east side of the AT&SF Railroad right-of-way. Then
northeast on Topeka Street to Pate Road, then east on Pate Road to the site, The site is located on the
northwest corner of Pate Road and United Road, and
WHEREAS, the site is vacant and flat, sloping slightly toward the southeast. There are no
significant drainage patterns that cross the property. There are severa] residences to the west of the site; the
remaining property is vacant, and
WHEREAS, the property owner proposes to split the 20-p]us-acre parcel into four five-acre parcels.
There are several splits in the area, Previous splits have reduced parcels to 20-plus acres. The approved
General Plan designates this to be a rural area, and
WHEREAS, review ofFEMA FIRM Panel #040058-2170B indicates this parcel to be in Zone C,
not in the FEMA Special Flood Hazard Area, A Floodplain Use Permit is not required, and
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
June ]4, 1995, the Commission recommended APPROVAL for a Rezone subject to the following:

2, The submittal and recordation of a Parcel Plat prepared in accordance with Article 3,16 of
the Mohave County Subdivision Regulations and 102,04-B of the Standard Specifications
and Details is required,

3, That the Board of Supervisors accepts the dedication of the existing 42-foot easements
known as Pate Road and United Road along the south and east boundaries as road rights-of-
way. In addition, a 20-foot radius curve is required at the intersection of Pate Road and
United Road.
4. That the Board of Supervisors accepts the granting of the eight feet adjacent to the road
rights-of-way as a Public Utilities Easement (PUE).
5, The dedications and grantings required by the Rezone resolution shall be shown on the Parcel
Plat and accepted by the Board of Supervisors upon Parcel Plat recordation,
6. Each parcel shall meet or exceed its respective acreage exclusive of roadways,
7, Each parcel shall have ]egal access,
8, The Parcel Plat shall show any surface drainage and FEMA flood zones.
9, The appropriate zoning, building, environmental and floodplain permits will be obtained
prior to any development. These permits will not be issued until Parcel Plat recordation,
10, The rezone shall not become effective for 30 days after final Board of Supervisors approval
for the change in classification, as per ARS 11-829E,
1 ], If these conditions are not met within one year this approval will be void, If at the expiration
of this period the property has not been improved to meet the use for which it was
conditionally approved, the Board of Supervisors (after notification by registered mail to the
owner and applicant who requested the rezoning) shall schedule a public hearing to grant an
extension, determine compliance with the schedule for development, or cause the property
to revert to its former zoning classification, This action is in accordance with Arizona
Revised Statutes Annotated, Title I 1, Chapter 6, 11-832,
WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County, Arizona, June 18, 1995, and posted June 16, 1995, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
