F..-'-'\4-~ Y/98 RESOLUTION NO. 95-295 A RESOLUTION SETTING FORTH A REZONE OF LAKE MOHA VE RANCHOS, UNIT 14, LOT 500, IN SECTION 3, TOWNSHIP 25 NORTH, RANGE 19 WEST, FROM A-R (AGRICULTURAL. RESIDENTIAL) ZONE TO C-l (NEIGHBORHOOD COMMERCIAL) ZONE, IN THE MORAVE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on July 5, 1995, a public hearing was conducted to determine whether approval should be granted for a Rezone for the above described property as requested by Charles H. DiSalvo of Dolan Springs, Arizona, and WHEREAS, the applicant proposes this zone change to allow the development of an office building housing a small barber shop, rea] estate office, etc, This property is located east of Highway 93 and on the south side of Pierce Ferry Road between Ninth Street and Havasu Road. The site is accessed from Highway 93 via northeast on Pierce Ferry Road to the site, and WHEREAS, the property is flat and vacant. The surrounding land uses consist of several residences to the west, with the remaining property vacant, and WHEREAS, review of FEMA FIRM Panel #040058- I 775B indicates this parcel to be in Zone C, not in the FEMA Special Flood Hazard Area. A Floodplain Use Permit is not required, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on June 14, 1995, the Commission recommended APPROVAL for a Rezone subject to the following: 1. This property will be rezoned C- I (Neighborhood Commercia]). 2, The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations, Section 27,P (Site Plan ~quirements) must be completed and approved prior toapprova] of permits, '''-tf.0. q ':" 1:'" V"','l. 3, That the Board of Supervisors accepts the dedication of the 50-foot easement as a road right- of-way known as Pierce Ferry Road along the northwest boundary of this property, 4, The appropriate zoning, building, environmental and f1oodp]ain permits will be obtained, 5, The rezone shall not become effective until 30 days after final approval of the change in classification by the Board of Supervisors, as per ARS 11-829E, . I . . ". RESOLUTION NO. 95-295 Page 2 PAGE 2 OF 2 BK 2593 PG 307 (FEE~95-35904) 6, If these conditions are not met within one year this approval will be void, If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title] ], Chapter 6, 11-832, WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, June 18, 1995, and posted June 16, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations, NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Wednesday, Ju]y 5, 1995, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein, MORAVE COUNTY BOARD OF SUPERVISORS ATTEST: ~~d# Pat Holt, Chairman
