II' RESOLUTION NO. 95-293 t:~ C .....i' ;D <<' l/ -i (V tP~~~ ~JQ~'1 ~~.CJ?'W"" ~D(2- j\ i;F I~;. \1 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR A REZONE OF SECTION 8 (EXCEPTING THE A TCHISON, TOPEKA AND SANTA FE RAIL WAY RIGHT -OF - WAY AND STATION GROUNDS) AND A PORTION OF SECTIONS 5 AND 17, TOWNSHIP 16 NORTH, RANGE 19 WEST, FROM A-R/36A (AGRICULTURAL-RESIDENTIAL/THIRTY-SIX ACRE MINIMUM LOT SIZE) TO M.X (HEA VY MANUFACTURING) LOCATED IN THE MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on July 5, 1995, a public hearing was conducted to determine whether approval should be granted for an Extension of Time for a Rezone to Waste Management of Phoenix, Phoenix, Arizona, and WHEREAS, the property is located east of Highway 95 and north of the 1-40 Franconia Road interchange, and WHEREAS, the original rezone request for this site was approved in January of 1990. and Extensions of Time have been granted on a yearly basis since the rezone was approved. The most recent extension was granted on October 4, 1994, per BaS Resolution No. 94-310. This resolution granted an extension until January 22, 1995. An additional condition was added by the Board of Supervisors requiring the following information be submitted with the next Extension of Time: A copy of the sections of the private agreement between Franconia Technologies, a waste management company, and the AT&SF Railroad that pertain to the crossing of the railroad's tracks, to the dedication of that crossing to Mohave County, and to any items that reference BaS Resolution No. 90- I 5 or are intended to meet any conditions contained in that Resolution. Responses regarding the design of the elevated roadway have been received from the Arizona Corporation Commission, the Mohave County Public Works Department and the AT&SF Railroad, and WHEREAS, Franconia Technologies has submitted a letter listing the events detailing the development of the project. The letter indicates that significant progress has been made toward the development of the project and requests the granting of a two-year Extension of Time; however. one of the conditions of BOS Resolution No. 90-15 is that Extensions of Time be granted in one-year increments, and WHEREAS, the plans for the bridge which will provide access to the site from 1-40 have been reviewed by the Mohave County Public Works Department for Floodplain requirements. The County Engineer is considering contracting the plan review for the bridge to a private agency for structural review, and RESOLUTION NO. 95-293 Page 2 . . tt WHEREAS, a Jetter dated April 4, 1995, from Waste Management of Arizona indicates the following: "Based on the continuance granted us by the Planning and Zoning Commission at your March 8 meeting, Franconina Technologies' request for an extension to our zoning is currently scheduled to be heard at your April 12 meeting. During the last couple of weeks, we have had extensive and productive discussions with members of the Board of Supervisors concerning our request for an extension of time. Those discussions are continuing and we now would like to request a 60-day continuance so that all questions raised by the Board of Supervisors can be answered prior to the Commission considering the easel!, and WHEREAS, this item was scheduled for the April Planning and Zoning Commission Meeting and was continued for 60 days, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on June 14, 1995, the Commission recommended APPRO V AL for an Extension of Time subject to the following: I. Compliance with all conditions of BaS Resolution Nos. 90-]5, 90-289, 91-30, 9]-315, 92- 35,92-398, and 94-310. 2. This Extension of Time will be in effect until January 22, 1996. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, June] 8, 1995, and posted June 16, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Wednesday, July 5, 1995, APPROVED this Extension of Time as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
