PAGE 1 OF 2 HOHAVE COUNTY BOARD OF SUPERVISORS RECORC.]HG FEE 0.00 ~IC RESOLUTION NO. 95.292 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR A REZONE OF A PORTION OF THE W1f2 W1f2 OF SECTION 8, TOWNSHIP 20 NORTH, RANGE 17 WEST, LYING BETWEEN THE SOUTHERLY RIGHT-OF-WAY LINE OF HIGHWAY 66 AND THE NORTHERLY RIGHT-OF.WAY LINE OF THE AT&SF RAILROAD, FROM A.RlI0A (AGRICULTURAL.RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE TO Ml2A (GENERAL MANUF ACTURING/TWO ACRE MINIMUM LOT SIZE) ZONE, IN THE MOHA VE COUNTY GENERAL AREA, MORAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on July 5, ] 995, a public hearing was conducted to determine whether approval should be granted for an Extension of Time for the above described property as requested by Derryl Smith of Kingman, Arizona, and WHEREAS, the property is located southwest of the City of Kingman, between Interstate 40 and the AT &SF rail line south of the Oatman/McConnico Interchange. The property is accessed from Interstate 40 via the OatmanlMcConnico Interchange, then east to the Frontage Road, then south on the Frontage Road to the property, and WHEREAS, the owner of the property has leveled the lot and has moved equipment and some materials, part of which will be used for a fence, onto the property. Very little work has been done to complete the conditions of approval as required by BOS Resolution No. 92-195, and WHEREAS, this Rezone was conditionally approved by the Mohave County Board of Supervisors on June 1, 1992, per BOS Resolution No. 92-] 95. It was extended the first time via BOS Resolution No. 93-220 on August 2, 1993, and a second time on August 9, 1994, via BOS Resolution No. 94-271, and WHEREAS, the applicant requested in an undated letter received on April 14, 1995, that the Zoning Use Permit be extended for one year. The letter stated that he has purchased materials and has invested a lot of time and labor in this project. He has sections of fence completed and is ready to set up as soon as the lot leveling is completed, and WHEREAS, this will be the third Extension of Time for this property. Mr. Smith has had more than enough time to accomplish the conditions of the original resolution. Mr. Smith should demonstrate progression on this project before being granted another Extension of Time, and WHEREAS, the Planning and Zoning Department originally recommended denial for this Extension of Time hased on the following: Mr. Smith has not accomplished the conditions of approval of BOS Resolution No. 92-195, dated June I. 1992, and the Extension of Time Policy has not been met and the resolutions for this property should be rescinded. . Continued compliance with the conditions of BOS Resolution No. 92-195. 2. This Extension of Time will be in effect until June 1, 1996. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, June 18, 1995, and posted June 16, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Wednesday, July 5, 1995, APPROVED this Extension of Time as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
