RESOLUTION NO. 95-287
A RESOLUTION SETTING FORTH A REZONE OF GOLDROAD STATION, UNIT 8, PARCEL
8, IN SECTION 30, TOWNSHIP 20 NORTH, RANGE 18 WEST, FROM A-R/36A
(AGRICULTURAL-RESIDENTIAL/THIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE TO A-
R/I0A (AGRICULTURAL-RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE, IN THE
GOLDEN VALLEY AREA, MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on July 5,
1995, a public hearing was conducted to determine whether approval should be granted for a Rezone for the
above described property as requested by Kostas Zistatasis and Panagiotis Zistas of Phoenix, Arizona, and
WHEREAS, the property is located north of Oatman Road between Tombstone Trail and Desert
View Trail. This property is accessed from Oatman Road via north on Tombstone Trail to Wingate Drive
and to the site. The site is located on the northwest corner of Wingate Drive and Tombstone Trail, and
WHEREAS, the site is vacant, relatively flat and slopes slightly to the southeast. There are no
significant drainage patterns that cross the property. There is one residence south of the site; the remainder
of the surrounding property is vacant, and
WHEREAS, the property owner proposes to split the 37-plus-acre parcel into two ten-acre parcels
and one 17 -acre parcel. There is one other split of similar nature in the area, reducing the 37-plus-acre parcel
to two IS-plus-acre parcels. The approved General Plan designates this to be a rural area, and
WHEREAS, review of FEMA FIRM Panel #040058-2500B indicates this parcel to be in Zone A,
in the FEMA Special Flood Hazard Area. A Floodplain Use Permit is required for any development, and
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
June 14, ] 995, the Commission recommended APPROVAL for a Rezone subject to the following:
I. These parcels will be rezoned A-R/IOA (Agricultural-Residentialrren-Acre Minimum Lot
Size).
2. The submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of
the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications
is required.
3. That the Board of Supervisors accepts the dedication of a 20-foot radius curve at the
intersection of Wingate Drive and Tombstone Trail adjacent to the property.

4. That the Board of Supervisors accepts the granling of the eight feet adjacent to the road
rights-of-way as a Public Utilities Easement (PUE).
5. The dedications and grantings required by the Rezone resolution shall be shown on the Parcel
Plat and accepted by the Board of Supervisors upon Parcel Plat recordation.
6. Each parcel shall meet or exceed its respective acreage exclusive of roadways.
7. Each parcel shall have legal access.
8. The Parcel Plat shall show any surface drainage and FEMA flood zones.
9. The appropriate zoning, building, environmental and floodplain permits will be obtained
prior to any development. These permits will not be issued until Parcel Plat recordation.
10. The rezone shall not become effective for 30 days after final Board of Supervisors approval
for the change in classification, as per ARS 11-829E.
II. If these conditions are not met within one year this approval will be void. If at the expiration
of this period the property has not been improved to meet the use for which it was
conditionally approved, the Board of Supervisors (after notification by registered mail to the
owner and applicant who requested the rezoning) shall schedule a public hearing to grant an
extension, determine compliance with the schedule for development, or cause the property
to revert to its former zoning classification. This action is in accordance with Arizona
Revised Statutes Annotated, Title 11, Chapter 6, I] -832.
WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County, Arizona, June ]8, ]995, and posted June 16, 1995, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Wednesday, July 5, ] 995, APPROVED this Rezone as recommended by the Mohave County Planning
and Zoning Commission and outlined herein.
