P'AGE 1 OF 3 HOHAVE CnUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 NC RESOLUTION NO. 95-267 A RESOLUTION SETTING FORTH A REZONE OF THE NEJ.,~ SE% NE% OF SECTION 10, TOWNSHIP 39 NORTH, RANGE 16 WEST, FROM R-EIlOA (RESIDENTIAL-REcREA TION/TEN ACRE MINIMUM LOT SIZE) ZONE TO R-E/5A (RESIDENTIAL-REcREATIONIFIVE ACRE MINIMUM LOT SIZE) ZONE, IN THE ARIZONA STRIP AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on July 5, 1995, a public hearing was conducted to determine whether approval should be granted for a Rezone for the above described property as requested by William B. and Patricia E. Sevy of St. George, Utah, and WHEREAS, the property is located south of Interstate 15, south of the Virgin River, east of the Arizona/Nevada state line and southwest of Littlefield. This property is accessed from the south via east on Elbow Canyon Road to the southeast comer of Section 15 in the Virgin River Ranches Valley View Addition subdivision where the road becomes Virgin Valley Way. Then east on Virgin Valley Way to Zion Parkway, then north on Zion Parkway to the northeast corner of Section 15 where the road becomes Cottontail Road in the Franhi Chaparral Estates Subdivision, then north on Cottontail Road to the site. The site is located approximately one-half mile north of the southeast corner of Section lOon the west side of Cottontail Road. and WHEREAS, the site is vacant and flat, sloping slightly to the northwest toward the Virgin River. There are no significant drainage patterns that cross the property. There are a few scattered residences to the east of the site, and WHEREAS, the property owner proposes to split the ten-acre parcel into two five-acre parcels. There are several similar splits in the area reducing parcels to five acres. If in a rural area the services will be minimal, and WHEREAS, review ofFEMA FIRM Panel #040058-0200B indicates this parcel to be in Zone C, not in the FEMA Special Flood Hazard Area. A Floodplain Use Permit is not required, and WHEREAS, the Mohave County Public Works Department recommends denial because their records do not indicate any legal access to the property. However, the County is working on obtaining right- of-way for Elbow Canyon Road. NOTE: The Assessor's Maps reflect that there are a series of roadway easements to this property, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on June 14, 1995, the Commission recommended APPROVAL for a Rezone subject to the following: '" . . RESOLUTION NO. 95-267 Page 2 PAGE 2 OF 3 BK 2591 PG 416 \FEE~9::;-35(72) I. These parcels will be rezoned R-E/5A (Residential-Reereation/Five-Acre Minimum Lot Size). 2. The submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications and Details is required. 3. That the Board of Supervisors accepts the granting of the north 25 feet as an Ingress and Egress (I&E) easement. 4. The granting required by the Rezone resolution shall be shown on the Parcel Plat and accepted by the Board of Supervisors upon Parcel Plat recordation. 5. Each parcel shall meet or exceed its respective acreage exclusive of roadways. 6. Each parcel shall have legal access. 7. The Parcel Plat shall show any surface drainage and FEMA flood zones. 8. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. 9. The rezone shall not become effective for 30 days after final Board of Supervisors approval for the change in classification, as per ARS 11-829E. 10. If these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board of Supervisors (after notification by registered mail to the. owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, June 18, 1995, and posted June 16, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. ~ . . .
