PAGE 1 OF 2 MOHAVE C(1UNTY 80ARD OF SlIPERvISORS RECORDI~G FEE 0.00 He RESOLUTION NO. 95-255 A RESOLUTION SETTING FORTH A REZONE OF LAKE MOHA VE COUNTRY CLUB ESTATES, UNIT 3, AMENDED, BLOCK K, LOT 26, IN SECTION 31, TOWNSHIP 22 NORTH, RANGE 16 WEST, FROM R-M/IA (MULTIPLE-RESIDENTIAL/ONE ACRE MINIMUM LOT SIZE) ZONE TO c-2H (GENERAL COMMERCIAL HIGHWAY FRONTAGE) ZONE, IN THE KINGMAN AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on June 5, 1995, a public hearing was conducted to determine whether approval should be granted for a Rezone for the above described property as requested by Michael R. and Patricia Colwell of Kingman, Arizona, and WHEREAS, the applicants propose this zone change to develop an office complex. The site is located east of Stockton Hill Road and south of Northern Avenue. The site is accessed from Stockton Hill Road via east on Northern Avenue to North Van Nuys Road. The property is located on the southeast comer of Northern Avenue and North Van Nuys Road, and WHEREAS, the property is vacant, flat and slopes slightly to the east. The surrounding land uses consist of other commercial buildings to the north along Northern Avenue and homes to the south, east and west, and WHEREAS, review of FEMA FIRM Panel #040058-2165C indicates this parcel to be in Zone C, not in the FEMA Special Flood Hazard Area. A Floodplain Use Permit is not required, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on May 10, 1995, the Commission recommended APPROVAL for a Rezone subject to the following: 1. This property will be rezoned C-2H (General Commercial Highway Frontage). 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits. 3. That the Board of Supervisors accepts the dedication of a 30-foot radius curve at the northeast comer of this property as a public road right-of-way. 4. The appropriate zoning, building, environmental and floodplain permits will be obtained. ,I - - . . RESOLUTION NO. 95-255 PAGE 2 OF BK 2577 PG 2 585 Page 2 (F<.E;95-29327) 5. The rezone shall not become effective until 30 days after final approval of thc change in classification by the Board of Supervisors, as per ARS 11-829E. 6. If these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. ATTEST: MORAVE COUNTY BOARD OF SUPERVISORS WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, May 21,1995, and posted May 19, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, June 5,1995, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein. ~w~ Pat Holt, Chairman ,
