RESOLUTION NO. 95-250
A RESOLUTION SETTING FORTH A REZONE OF A PORTION OF THE SYZ SWY- OF
SECTION 5, TOWNSHIP 20 NORTH, RANGE 17 WEST, FROM A (GENERAL) ZONE TO CoMO
(COMMERCIAL-MANUFACTURING/OPEN LOT STORAGE) ZONE IN THE KINGMAN AREA,
MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on June 5,
1995, a public hearing was conducted to determine whether approval should be granted for a Rezone for the
above described property as requested by Arthur A. Arnold of Kingman, Arizona, and
WHEREAS, the applicant proposes this zone change to develop a service station and truck stop.
The site is located on the south side of Oatman Road and is split by the Interstate 40/McConnico/Oatman
Road Exit access road. The site is accessed from Interstate 40 via the McConnico/Oatman Road Exit, and
WHEREAS, the property is vacant, flat and slopes slightly to the south. The surrounding land to
the north, east and south is vacant. There is a house and Roadway Express Company located on the west
side, and
WHEREAS, review ofFEMA FIRM Panel #040058-2325B indicates this parcel to be in Zone C,
not in the FEMA Special Flood Hazard Area. A Floodplain Use Permit is not required, and
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
May 10, 1995, the Commission recommended APPROVAL for a Rezone subject to the following:
1. This property will be rezoned C-MOIl5A (Commercial-Manufacturing/Open Lot Storage/
Fifteen Acre Minimum Lot Size).
2. The Open Lot Storage must be associated with the service station and truck stop and cannot
be established until those uses are established.
3. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior
to approval of permits.
4. The submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of
the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications
and Details is required.

5. That the Board of Supervisors accepts the dedication of that portion of State Highway 66 and
the Frontage Access Road along the boundary of this parcel as a public road right-of-way.
In addition, a 45- foot radius curve is required at the intersection of State Highway 66 and the
Frontage Access Road.

6. The dedications required by the rezone resolution shall be shown on the Parcel Plat and
accepted by the Board of Supervisors upon Parcel Plat recordation.
7. The Parcel Plat shall show any surface drainage and FEMA flood zones.
8. The appropriate zoning, building, environmental and floodplain permits will be obtained
prior to any development. These permits will not be issued until Parcel Plat recordation.
9. The rezone shall not become effective for 30 days after final Board of Supervisors approval
for the change in classification, as per ARS 11-829E.
10. If these conditions are not met within one year this approval will be void. If at the expiration
of this period the property has not been improved to meet the use for which it was
conditionally approved, the Board of Supervisors (after notification by registered mail to the
owner and applicant who requested the rezoning) shall schedule a public hearing to grant an
extension, determine compliance with the schedule for development, or cause the property
to revert to its former zoning classification. This action is in accordance with Arizona
Revised Statutes Annotated, Title 11, Chapter 6, 11-832.
WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County, Arizona, May 21,1995, and posted May 19, 1995, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, June 5, 1995, APPROVED this Rezone as recommended by the Mohave County Planning and
Zoning Commission and outlined herein.
