HomeMy WebLinkAbout95-327 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on Ju]y 12,1995, the Commission recommended APPROVAL for a Rezone subject to the following: a, All notices have been advertised and posted according to regulations, b, The proposed action and the effect on the property are in concurrence with the Mohave County General Plan and the property is in a designated 'Outlying Community'. c, The site of the parcel is adequate for the action intended and the use is consistent with the surrounding land uses and terrain, d, The proposal is to create lots for single-family dwellings. e, The neighboring area contains other like land use splits similar to the above proposed action, f. A review ofFEMA FIRM Pane] #040058-l975B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, A Floodplain Use Permit is not required, g, The site has legal access, h, There are no significant environmental features or problems affecting the site, WHEREAS, the following described Findings of Fact are for the above-captioned item: WHEREAS, the property is located in the old Chloride Townsite on parcels known as the Old Chloride Depot. This property is accessed from Highway 93 via east on Chloride Road, also known as Mohave County Route 125, which becomes Tennessee Avenue in the Chloride Townsite, to Second Street, then north on Second Street to the site. The property has severa] old buildings including the old train depot on it. There is a minor wash running east and west through the middle of the property, and WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on August 7, 1995, a public hearing was conducted to determine whether approval should be granted for a Rezone for the above described property as requested by Rona]d H, Hu]se of Chloride, Arizona, and A RESOLUTION SETTING FORTH A REZONE OF PARCELS KNOWN AS THE OLD CHLORIDE DEPOT, IDENTIFIED AS MORAVE COUNTY ASSESSOR'S PARCEL NUMBERS 308-06-573 AND 308-06-570, ON MAP DATED DECEMBER 9, 1994, IN SECTION 3, TOWNSHIP 23 NORTH, RANGE 18 WEST, FROM A (GENERAL) ZONE TO R-l (SINGLE-FAMILY RESIDENTIAL) ZONE, IN THE CHLORIDE PORTION OF THE MORAVE COUNTY GENERAL AREA, MORAVE COUNTY, ARIZONA. RESOLUTION NO. 95-327 MICROALMW ~NDEXEO . ~J WHEREAS, the notice of hearing was published in the Kingman Dai]y Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, July 23, ]995, and posted July 21, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations, 11, If these conditions are not met within one year this approval will be void, If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the properly to revert to its former zoning classification, This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6,11-832, 10, The rezone shall not become effective until at least 30 days after final Board of Supervisors approval for the change in classification, as per ARS ll-829E, 9, The appropriate zoning, building, environmental and floodplain permits will be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. 8, The Parcel Plat shall show any surface drainage and FEMA flood zones, 7, Each parcel shall have legal access. 6, Each parcel shall meet or exceed its respective acreage exclusive of roadways, 5, The grantings required by the Rezone resolution shall be shown on the Parcel Plat and accepted by the Board of Supervisors upon Parcel Plat recordation, 4, That the Board of Supervisors accepts the granting of the eight feet adjacent to Schuylkill Avenue as a Public Utilities Easement (PUE). 3, That the Board of Supervisors accepts the granting of an IngresslEgress (I&E) access easement across this parcel from Schuylkill Avenue to the northern boundary of this parcel in order to provide access to the land]ocked parcels on the north side. In addition, access has to be provided from the interior concrete building parcel within this property to Schuy]kill Avenue, 2, The submittal and recordation of a Parcel Plat prepared in accordance with Article 3,16 of the Mohave County Subdivision Regu]ations and 102,04-B ofthe Standard Specifications and Details is required, 1.
