RESOLUTION NO. 95-326 A RESOLUTION SETTING FORTH A REZONE OF MOUNTAIN VISTA RANCHES, PHASE I, PARCEL 27-14, IN SECTIONS 26 AND 27, TOWNSHIP 24 NORTH, RANGE 15 WEST, FROM A-R/36A (AGRICULTURAL-RESIDENTIALrrHIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE TO A-R/5 (AGRICULTURAL-RESIDENTIAL/FIVE ACRE MINIMUM LOT SIZE) ZONE AND A-R/20 (AGRICULTURAL-RESIDENTIALrrWENTY ACRE MINIMUM LOT SIZE) ZONE, IN THE MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on August 7, 1995, a public hearing was conducted to determine whether approval should be granted for a Rezone for the above described property as requested by Eldon L. and Sherrol A. Pitts of Kingman, Arizona, and WHEREAS, the property is located west of Highway 66 and north ofthe Valle Vista Subdivision. This property is accessed from Highway 66 then north on Concho Drive through the Valle Vista Subdivision to Painted Rock Drive, then east and north on Painted Rock Drive to the site, The property is located on the northwest side of Painted Rock Drive. The property is vacant and flat, sloping slightly toward the west. There are no significant drainage patterns that cross the property, The surrounding land is vacant, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a, All notices have been advertised and posted according to regulations, b, The proposed action and the effect on the property are in concurrence with the Mohave County Genera] Plan and the property is in a designated Rural Area, c. The site of the parcel is adequate for the action intended and the use is consistent with the surrounding land uses and terrain, d, The proposal is to split the 38-plus-acre parcel into two six-acre parcels and one 26-acre parcel. e. The neighboring area contains other like land use splits similar to the above proposed action, f, A review ofFEMA FIRM Panel #040058-2025B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, A Floodplain Use Permit is not required, g, The site has legal access, h, There are no significant environmental features or problems affecting the site, WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on July 12, 1995, the Commission recommended APPROVAL for a Rezone subject to the following: . . The northeast and southwest 6-acre parcels will be rezoned A-R/5A (Agricultural- ResidentiallFive Acre Minimum Lot Size) and the remaining 26-acre parcel will be rezoned A-R/20A (Agricultural-Residential/Twenty Acre Minimum Lot Size), 2, The submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regu]ations and 102.04-B of the Standard Specifications and Detai]s is required, 3, That the Board of Supervisors accepts the dedication of the 30-foot easements for Nuttall Drive and Brooks Boulevard as public road rights-of-way and matching rights-of-way be dedicated for Campolindo Lane, In addition, 20-foot radius curves are required at all dedicated roadway intersection points, 4, That the Board of Supervisors accepts the granting of the eight feet adjacent to all road rights-of-way as a Public Utilities Easement (PUE), 5. The dedications and grantings required by the Rezone resolution shall be shown on the Parcel Plat and accepted by the Board of Supervisors upon Parcel Plat recordation, 6, Each parcel shall meet or exceed its respective acreage exclusive of roadways, 7, Each parcel shall have lega] access, 8, The Parcel Plat shall show any surface drainage and FEMA flood zones, 9. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to any development, These permits will not be issued until Parcel Plat recordation, 10, The rezone shall not become effective until at least 30 days after final Board of Supervisors approval for the change in classification, as per ARS 11-829E. I 1 , If these conditions are not met within one year this approval will be void, If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification, This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832, WHEREAS, the notice of hearing was published in the Kingman Dai]y Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, Ju]y 23, 1995, and posted Ju]y 21, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations, RESOLUTION NO. 95-326 Page 3 . .
