A RESOLUTION SETTING FORTH A REZONE OF THE NWY< SEY< OF SECTION 34,
TOWNSHIP 21 NORTH, RANGE 18 WEST, FROM A-R/36A (AGRICULTURAL-RESIDENTIAL/
THIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE TO A-R/6A (AGRICULTURAL-
RESIDENTIAL/SIX ACRE MINIMUM LOT SIZE) ZONE, IN THE GOLDEN VALLEY AREA,
MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on August 7,
1995, a public hearing was conducted to determine whether approval should be granted for a Rezone for the
above described property as requested by James C, and Dora L. Green of Golden Valley, Arizona, and
WHEREAS, the property is located about four miles south of Highway 68 between Adobe Road
and Aztec Road, This property is accessed from Highway 68 via south on Aztec Road to a 60-foot access
easement through Parcel 53, then west on the 60-foot access easement to the site, The 6O-foot access
easement is about one-half mile south of Unkar Drive, The property is vacant and flat, sloping slightly to
the southeast. There are no significant drainage patterns that are visible that cross the property, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a, All notices have been advertised and posted according to regulations,
b, The proposed action and the effect on the property are in concurrence with the Mohave
County Genera] Plan and the property is in a designated Rural Area.
c, The site of the parcel is adequate for the action intended and the use is consistent with the
surrounding land uses and terrain,
d, The proposal is to split the 40-acre plus parcel into five six-acre plus parcels,
e, The neighboring area contains other like land use splits similar to the above proposed action,
f, A review ofFEMA FIRM Pane] #040058-2325B indicates the parcel described to be in Zone
A, in the Special Flood Hazard Area requiring a permit before any development.
g, The site has legal access,
h, There are no significant environmental features or problems affecting the site,
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
Ju]y 12, 1995, the Commission recommended APPROVAL for a Rezone subject to the following:
1. These parcels will be rezoned A-R/6A (Agricultura]-Residential/Six Acre Minimum Lot
Size) as shown on Exhibit "A".

2. The submittal and recordation of a Parcel Plat prepared in accordance with Article 3,16 of
the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications
and Details is required,
3. That the Board of Supervisors accepts the granting of a 60- foot access easement between the
two northern parcels and the three southern parcels as shown on Exhibit "A", In addition,
the applicant must provide documentation for the 60-foot access easement through the
adjacent 40-acre parcel on the east side to provide access to Aztec Road.
4. The dedications and grantings required by the Rezone resolution shall be shown on the
Parcel Plat and accepted by the Board of Supervisors upon Parcel Plat recordation.
5, Each parcel shall meet or exceed its respective acreage exclusive of roadways,
6, Each parcel shall have lega] access, this documentation shall be provided prior to the Parcel
Plat recordation,
7, The Parcel Plat shall show any surface drainage and FEMA flood zones,
8, The appropriate zoning, building, environmental and floodplain permits will be obtained
prior to any development. These permits will not be issued until Parcel Plat recordation,
9, The rezone shall not become effective until at least 30 days after final Board of Supervisors
approval for the change in classification, as per ARS 1 1 -829E,
10. If these conditions are not met within one year this approval will be void, If at the expiration
of this period the property has not been improved to meet the use for which it was
conditionally approved, the Board of Supervisors (after notification by registered mail to the
owner and applicant who requested the rezoning) shall schedule a public hearing to grant an
extension, determine compliance with the schedule for development, or cause the property
to revert to its former zoning classification, This action is in accordance with Arizona
Revised Statutes Annotated, Title 11, Chapter 6,11-832,
WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County, Arizona, Ju]y 23, 1995, and posted July 21, 1995, as
required by Arizona Revised Statutes and the Mohave County Zoning Regu]ations,

NOW THEREFORE BE IT RESOL YED, that the Board of Supervisors, at their regular meeting
on Monday, August 7, 1995, APPROVED this Rezone as recommended by the Mohave County Planning
and Zoning Commission and outlined herein,
