RESOLUTION NO. 95-322 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR THE APPROVED PRELIMINARY SUBDIVISION PLAN FOR SHIPP ESTATES III, TRACT 3026, BEING PARCELS 13 AND 14, AND THE SY> OF THE SY> OF PARCEL 15, SECTION 12, TOWNSHIP 21 NORTH, RANGE 19WEST,IN THE GOLDEN V ALLEY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on August 7, 1995, a public hearing was conducted to determine whether approval should be granted for an Extension of Time to Jesus G, Reyes ofGV Development Inc" owner/developer, of Golden Valley, Arizona, and WHEREAS, the subdivision is located south of Highway 66 and west of Teddy Roosevelt Road, and WHEREAS, a letter dated April 12, 1995, from Jesus G, Reyes ofGV Development, Inc" requests "an Extension of time for the Preliminary Plan for Shipp Estates III, Tract 3026 which expires on May 5, 1995, We have a delay on all our projects in Golden Valley because we have changed our Deve]opment Management Company," In another letter dated May 8, 1995 from Mr. Reyes, "A]so the reason for requesting an extension is because we are waiting approval of Construction Plans from ADEQ, We are pursuing Phase B and C of Ship Estates II, Tract 3026", and WHEREAS, the Mohave County Public Works Department requests compliance with current requirements, Final plats must show compatibility with drainage and circulation patterns of recent nearby development, and WHEREAS, the Preliminary Plan for this tract was approved by the Mohave County Board of Supervisors on May 7,1990, per BaS Resolution No. 90-120. The first Extension of Time was granted on September 7, 1993, per BaS Resolution No, 93-255, The second Extension of Time was granted on September 6, 1994, per BaS Resolution No. 94-298, Article 3.10-1 states, "Upon application to the commission and prior to the expiration of the time limit, extensions in increments of one (1) year may be granted by the Board if the subdivider is actively processing the final Plat. If such action is not taken then all proceedings relating to the plat shall be terminated", and WHEREAS, this will be the third Extension of Time, and WHEREAS, the following described Findings of Fact are for the above-captioned item: ~ .. . . The proposed action is in concurrence with the Mohave County General Plan, and the property is designated in an "Urban" Area, c, The site is adequate for the action intended and the use is consistent with the surrounding land uses. d. The Preliminary Plan depicts 90 acres subdivided into 280 single-family lots, ranging in size from 8,000 square feet to 14,000 square feet. e, The engineer of record for the subdivision is Mohave Engineering of Kingman, Arizona, f, Phase "A" of the subdivision has been recorded and improved, WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on July 12, 1995, the Commission recommended APPROVAL for an Extension of Time subject to the following: 1. Compliance with all conditions of BaS Resolution Nos. 90-120, 93-255 and 94-298, 2, This Extension of Time will be in effect until May 7, 1996. WHEREAS, the notice of hearing was published in the Kingman Dai]y Miner, a newspaper of genera] circulation in Kingman, Mohave County, Arizona, Ju]y 23, 1995, and posted Ju]y 21, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regu]ations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, August 7,1995, APPROVED this Extension of Time as recommended by the Mohave County Planning and Zoning Commission and outlined herein, ATTEST: MOHA VE COUNTY BOARD OF SUPERVISORS ~~~- Pat Holt, Chairman
