RESOLUTION NO. 95-320
A RESOLUTION SETTING FORTH A REZONE OF LE CLAIR ACRES, LOTS 9, 12, 17 AND 20,
IN SECTION 15, TOWNSHIP 19 NORTH, RANGE 22 WEST, FROM A-R (AGRICULTURAL-
RESIDENTIAL) ZONE TO R-M (MULTIPLE-RESIDENTIAL) ZONE, IN THE SOUTH MORAVE
VALLEY AREA, MORAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on August 7,
1995, a public hearing was conducted to determine whether approval should be granted for a Rezone for the
above described property as requested by the Mohave County Planning and Zoning Department, and
WHEREAS, the Planning and Zoning Department proposes this zone change to correct
administrative errors made in 1974 and 1981. This property is located south of Bullhead City and west of
Highway 95 in the Le Clair Acres Subdivision, The site is accessed from Highway 95 via west on Valencia
Road to Cavalry Road, The site is located east of Cavalry Road between Valencia Road and Camp Mohave
Road, The property is relatively flat, sloping slightly toward the west and the Colorado River and it is
mostly vacant with several residences, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations,
b. The proposed action and the effect on the property are in concurrence with the Mohave
County General Plan and the property is in a designated Urban Area.
c, The site of the parcel is adequate for the action intended and the use is consistent with the
surrounding land uses and terrain,
d, The proposed zone change to R-M (Multiple-Residentia]) is to correct administrative errors
made in 1974 and 1981.
e, The neighboring area contains other like land use splits similar to the above proposed action.
f A review ofFEMA FIRM Panel #040058-2435D indicates a portion of the southeast corner
of Lot 20 to be in Zone AO, in the Special Flood Hazard Area, requiring a permit before any
development. The remaining portion of Lot 20 and Lots 9, 12, and 17 are in Zone C, not in
the FEMA Special Flood Hazard Area, A Floodp]ain Use Permit is not required,
g. The site has legal access,
h. There are no significant environmental features or problems affecting the site,
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
July 12, 1995, the Commission recommended APPROVAL for a Rezone subject to the following:

1, Le Clair Acres, Lots 9, 12, 17 and 20, will be rezoned to R-M (Multip]e-Residentia]),
2. The rezone shall not become effective until at least 30 days after final approval of the change
in classification by the Board of Supervisors, as per ARS 11 -829E,
WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County, Arizona, July 23, 1995, and posted July 21, 1995, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations,
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, August 7, 1995, APPROVED this Rezone as recommended by the Mohave County Planning
and Zoning Commission and outlined herein.
