Az ,1C<1\t-l MCCt,L U 1'10HIl\'C CC<llt-lH RECORDER 08i03/95 04: 06f' PAGE 1 OF 3 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 RESOLUTION NO. 95-318 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR THE APPROVED PRELIMINARY SUBDIVISION PLAN AND PETITION OF EXCEPTION FOR MAUNA LANI VILLAGE, TRACT 4149, BEING A SUBDIVISION OF A PORTION OF SECTION 15, TOWNSIllP 17 NORTH, RANGE 22 WEST, IN THE SOUTH MOHA VE VALLEY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on August 7, 1995, a public hearing was conducted to determine whether approval should be granted for an Extension of Time to Michael 1. Mangana, Owen Development, Mohave Valley, Arizona and E] Monte, California, and WHEREAS, the subdivision is located west of Highway 95, south of Courtwright Road and north of Levee Drive and the Colorado River, and WHEREAS, the Preliminary Plan depicts 83 single-family lots, ranging in size from 8,000 square feet to 11,000 square feet, and WHEREAS, in a letter dated March 7, 1995, Michael J. Mangana of Owen Development requests an extension of time, and notes that they are in the process of developing Final Plans for the subdivision, Following are a few excerpts from another letter dated Apri] 12, 1995, from Michael J, Mangana: "We have put this project on temporary hold due to the economy of this area, We operate in five states and we do not feel this economy warrants the type of project we have planned at this time.., Our family owns this land, all 30-acres.., My neighbors would be very upset if we were to do a project that did not live up to our goals.,. Our family could have developed the project many years ago but waited until the proper time... Now we are in a downturn and no one knows how long it will last. When we started this project with the former Planning Director extensions of time were no problem you just request them. Now after we have spent $70,000,00 in engineering and planning we have to worry whether you're going to allow our project... Our plans are complete and we could record pending bonds and a couple of utility agreements. We have worked with FMTUA and designed a sewer system and water system, Your engineering department should have copies of all the work we have done,.. We do not need nor does this area need a bad project. Our family has been in the development business for generations and we can tell you that timing is everything in this business, Our family also loves the river and we have recreated here for decades, We will not do anything to jeopardize what this place means to us or our neighbors", and WHEREAS, a Final Plat and Improvement Plans were received by the Planning and Zoning Department in June of 1993, The Planning staff sent a response letter to the engineer requesting changes to the Final Plat on Ju]y 23,1993. Since that time there has been no response to this letter and no action has been taken to record the plat, and - . . RESOLUTION NO. 95-318 Page 2 PAGE 2 OF 3 BK 2605 PG 283 FEE~95041239 WHEREAS, the Mohave County Public Works Department requests compliance with current requirements; final plats must show compatibility with drainage and circulation patterns ofrecent nearby development, and WHEREAS, the Preliminary Plan for this tract was approved by the Mohave County Board of Supervisors on August 3, 1992, per BaS Resolution No. 92-257. The first Extension of Time was granted on Apri] 4, 1994, per BaS Reso]ution No. 94-97, Article 3.10-1 states, "Upon application to the commission and prior to the expiration of the time limit, extensions in increments of one (l) year may be granted by the Board if the subdivider is actively processing the Fina] Plat. If such action is not taken then all proceedings relating to the plat shall be terminated", and WHEREAS, this will be the second Extension of Time, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a, All notices have been advertised and posted according to regulations, b. The proposed action is in concurrence with the Mohave County General Plan, and the property is designated in an "Urban" Area, c, The site is adequate for the action intended and the use is consistent with the surrounding land uses. d, The Preliminary Plan depicts 83 single-family lots, ranging in size from 8,000 square feet to 11,000 square feet. e, The engineer of record for the subdivision is Civiltec Engineering, Inc, of Momovia, California, f, This item was continued from the June P&Z Commission meeting, WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on Ju]y 12, 1995, the Commission recommended APPROVAL for an Extension of Time subject to the following: 1, Compliance with all conditions of BaS Resolution Nos, 92-257 and 94-97, 2, This Extension of Time will be in effect until August 3,1996, WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of genera] circulation in Kingman, Mohave County, Arizona, Ju]y 23, 1995, and posted July 21, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations, RESOLUTION NO. 95-318 Page 3 ~ . . PAGE 3 OF 3 BK 2605 PG 284 FEE~95041239 NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, August 7,1995, APPROVED this Extension of Time as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
