OF SECTION 34, TOWNSHIP 41 NORTH, RANGE 15 WEST, FOR A WASTE WATER TREATMENT PLANT IN A M (GENERAL MANUFACTURING) ZONE, IN THE ARIZONA STRIP AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on August 7, 1995, a public hearing was conducted to determine whether approval should be granted for a Specific Use Permit for a waste water treatment plant for the above described property as requested by William L. Gates and John Johnson, doing business as Virgin River AZ of Littlefie]d, Arizona, and WHEREAS, the property is located north ofInterstate 15 and east of the I-15 Farm Road Exit in the Littlefield area, This property is accessed from the 1-15 Farm Road Exit, then north on the Frontage Road to the site, The site is located on the north side of the Frontage Road, The property is vacant and flat, sloping slightly to the north and west toward the Virgin River, There are several significant drainage patterns that cross the property, mostly along the northern part of this property toward the Virgin River, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a, All notices have been advertised and posted according to regulations. b, The proposed action and the effect on the property are in concurrence with the Mohave County General Plan and the property is in a designated Rural Area, c, The site of the parcel is adequate for the action intended and the use is consistent with the surrounding land uses and terrain, d, The proposal is to place a waste water treatment plant in the northwest portion ofthe SEY4 of Section 34 on about one acre, as shown on Exhibit "A", e, The neighboring area contains other like land uses similar to the above proposed action, f. A review ofFEMA FIRM Panel #040058-0025B indicates the parcel described to be in Zone A, in the Special Flood Hazard Area, requiring a permit before any development, g, The site has legal access. h, There are no significant environmental features or problems affecting the site, except for the noted location being in the Special Flood Hazard Zone A, WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on Ju]y 12, 1995, the Commission recommended APPROVAL for a Specific Use Permit subject to the following: . . . . RESOLUTION NO. 95-315 Page 2 PAGE 2 OF 3 BK 2605 PG 278 FEE~95041237 1, This Specific Use Permit is intended only for the waste water treatment plant and activities related thereto; any new use will require another Specific Use Permit, 2, The Specific Use Permit will commence upon the effective date of the rezone. 3, The applicant will obtain all applicable Federal, State and local approvals, 4. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations, Section 27,P (Site Plan Requirements) must be completed and approved prior to approval of permits, 5, The appropriate zoning, building, environmental and floodplain permits will be obtained. 6, Approval of a Specific Use Permit, with such conditions and restrictions as the Board of Supervisors may impose, shall be valid for two (2) years, in which time construction on the project shall commence or the use authorized shall be initiated, Prior to expiration of the approval, the developer may request an Extension of Time from the Commission to initiate the project, and the Commission shall recommend to the Board an action based upon a finding of substantial grounds of which to grant such an Extension of Time up to one (1) year, WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, July 23, 1995, and posted July 21, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, August 7, 1995, APPROVED this Specific Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein, MOHA VE COUNTY BOARD OF SUPERVISORS ~,~/~ Pat Holt, Chairman .'
