TEN ACRE MINIMUM LOT SIZE) ZONE TO C-RE (COMMERCIAL-RECREATION) ZONE, IN THE ARIZONA STRIP AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on August 7, 1995, a public hearing was conducted to determine whether approval should be granted for a Rezone for the above described property as requested by William L. Gates and John Johnson, doing business as Virgin River AZ of Littlefield, Arizona, and WHEREAS, the property is located north ofInterstate 15 and east of the 1-15 Farm Road Exit in the Littlefield area, This property is accessed from the 1-15 Farm Road Exit, then north on the Frontage Road to the site, The site is located on the north side of the Frontage Road, The property is vacant and flat, sloping slightly to the north and west toward the Virgin River. There are severa] significant drainage patterns that cross the property, mostly along the northern part of this property toward the Virgin River, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a, All notices have been advertised and posted according to regulations, b, The proposed action and the effect on the property are in concurrence with the Mohave County Genera] Plan and the property is in a designated Rura] Area, c, The site of the parcel is adequate for the action intended and the use is consistent with the surrounding land uses and terrain, d, The proposal is to develop a Mobile Home Park, RV Park and a Waste Water Treatment Plant on approximately 205 acres as shown on Exhibit "A". e, The neighboring area contains other like land use splits similar to the above proposed action, f, A review ofFEMA FIRM Pane] #040058-0025B indicates the parcel described to be in Zone A, in the Special Flood Hazard Area, requiring a permit before any development. g, The site has legal access, h, There are no significant environmental features or problems affecting the site, except for the noted location being in the Special F]ood Hazard Zone A. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on Ju]y 12, 1995, the Commission recommended APPROVAL for a Rezone subject to the following: - -- " . . RESOLUTION NO. 95-313 Page 2 P(;GE 2 OF 3 BK 2605 PG 272 FEE~95041235 1. The portion of this parcel as shown on Exhibit "A" will be rezoned C-RE (Commercia]- Recreation). 2. The applicant will obtain all applicable Federal, State and local approvals, 3, The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations, Section 27,1 (General Provisions, Mobile Home Parks), Section 27.1 (General Provisions, Recreational Vehicle Parks) and Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits, This will include a drainage report and the amount of grading this project will require in order to determine if a grading permit is required. 4, The appropriate zoning, building, environmental and floodplain permits will be obtained, 5, The rezone shall not become effective until at least 30 days after final approval of the change in classification by the Board of Supervisors, as per ARS 11-829E, 6, If these conditions are not met within one year this approval will be void, If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification, This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832, WHEREAS, the notice of hearing was published in the Kingman Dai]y Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, July 23, 1995, and posted Ju]y 21, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regu]ations, NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, August 7, 1995, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein, MOHA VE COUNTY BOARD OF SUPERVISORS ~:r:-' ~/~ Pat Ho]t, Chairman ".--' 'It" . .
