RESOLUTION NO. 95-304 A RESOLUTION SETTING FORTH A REZONE OF THAT PORTION OF THE El/z NEI~ OF SECTION 11, TOWNSHIP 20 NORTH, RANGE 14 WEST, LYING SOUTHERLY OF OLD HIGHWAY 93, FROM A-R/36A (AGRICULTURAL-RESIDENTIALrrHIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE TO A-R/5A (AGRICULTURAL-RESIDENTIAUFIVE ACRE MINIMUM LOT SIZE) ZONE, IN THE MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on Ju]y 5, ] 995, a public hearing was conducted to determine whether approval should be granted for a Rezone for the above described property as requested by Thomas N, and Marilyn K. Arrieta of San Jose, California being represented by C,S,N.A, Engineering of Kingman, Arizona, and WHEREAS, the property is located south of Interstate 40 and west of Highway 93, east of Kingman, This property is accessed from Highway 93 via northwest on "Old" Highway 93 to the site, The site is located on the south side of "Old" Highway 93 approximately four miles northwest of the Highway 93 and "Old" Highway 93 intersection, and WHEREAS, the site is vacant and has rolling terrain sloping toward the east. There are no residences or development in the area, There are several washes and drainage areas that cross the property, and WHEREAS, the property owner proposes to split the 46-plus-acre parcel into four five-acre parcels and one remaining parcel of 24-plus acres, There have been severa] splits in the area; the Sierra Vista Estates Subdivision to the southeast contains parcels of five acres, The approved General Plan designates, this to be a rural area, and WHEREAS, review of FEMA FIRM Pane] #040058-2375B indicates this parcel to be in Zone A, in the FEMA Special F]ood Hazard Area, A F]oodplain Use Permit is required for any development, and WHEREAS, the Mohave County Public Works Department requests that the 6O-foot right-of-way along the south boundary of this parcel be retained as a public roadway, NOTE: This is not a public roadway but private land and is a separate parcel that the previous owner had designated as a private roadway, The previous owner sold all of the EYz of the NP~ of Section] 1 south of "Old" Highway 93 to include this 60-foot-wide parcel along the southern boundary, In lieu of the 30-foot dedication along the west boundary of the parcel the department requests that the developer dedicate a 42-foot right-of-way along " 'f-- . . In the event that the developer wishes to retain the 30- foot roadway dedication along the west boundary, the department would not recommend the acceptance of this dedication and that this roadway would be granted as an lngress & Egress (l&E) easement. NOTE: This request by the Public Works Department is not proportional for the development for this area, However, the applicant has stated that they will dedicate a 35-foot road right-of-way on the southern side of the parcel and a 30-foot road right-of-way along the west boundary, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on June 14, 1995, the Commission recommended APPROVAL for a Rezone subject to the following: 1. The four northern parcels will be rezoned A-R/5A (AgriculturaI-ResidentiallFive Acre Minimum Lot Size) and the southern parcel will be rezoned A-R/15A (Agricu]tural- ResidentiallFifteen Acre Minimum Lot Size), 2, The submittal and recordation of a Parcel Plat prepared in accordance with Article 3,16 of the Mohave County Subdivision Regulations and 102,04-B of the Standard Specifications and Detai]s is required, 3. That the Board of Supervisors accepts the dedication of a 35-foot road right-of-way on the southern boundary, a 30-foot road right-of-way on the western boundary and a 42-foot road right-of-way on the eastern boundary of the parcel. In addition, 20-foot radius curves are required at all dedicated roadway intersection points, 4, That the Board of Supervisors accepts the granting of the eight feet adjacent to the County Route 93 road right-of-way as a Public Utilities Easement (PUE), 5, The dedications and grantings required by the Rezone resolution shall be shown on the Parcel , Plat and accepted by the Board of Supervisors upon Parcel Plat recordation, 6. Each parcel shall meet or exceed its respective acreage exclusive of roadways, 7. Each parcel shall have legal access. 8, The Parcel Plat shall show any surface drainage and FEMA flood zones, 9, The appropriate zoning, building, environmental and floodplain permits will be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. 10. The rezone shall not become effective for 30 days after final Board of Supervisors approval for the change in classification, as per ARS 11-829E, " , E- . RESOLUTION NO. 95-304 . If thcse conditions are not met within one year this approval will bc void, If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, thc Board of Supervisors (after notification by registered mail to the owner and applicant who requestcd the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification, This action is in accordance with Arizona Revised Statutes Annotated, Tit]e 1 ], Chapter 6, 11-832, WHEREAS, the notice of hearing was published in the Kingman Dai]y Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, June IS, 1995, and posted June 16, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regu]ations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Wednesday, Ju]y 5, 1995, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein, ATTEST: MOHA VE COUNTY BOARD OF SUPERVISORS %,/~L Pat Holt, Chairman
