A RESOLUTION SETTING FORTH A REZONE OF THE SEI;4 SWI;4 OF SECTION 11,
TOWNSHIP 20 NORTH, RANGE 14 WEST, EXCEPT THE SOUTH 60 FEET, FROM A-R/36A
(AGRICULTURAL-RESIDENTIALffHIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE TO A-
R/5A (AGRICULTURAL-RESIDENTIAUFIVE ACRE MINIMUM LOT SIZE) ZONE, IN THE
MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on July 5,
1995, a public hearing was conducted to determine whether approval should be granted for a Rezone for the
above described property as requested by George W, and Donna M. Ingersoll of Kingman, Arizona being
represented by C,S.N.A Engineering of Kingman, Arizona, and
WHEREAS, the property is located south of Interstate 40 and west of Highway 93, east of Kingman,
This property is accessed from Highway 93 via northwest on "Old" Highway 93 to Calle Apache in the
Sierra Vista Estates Subdivision, then east on Calle Apache to the end. At the end of Calle Apache the road
becomes a 60-foot Roadway and Public Utilities Easement (RIW and PUE) and continues west to the site,
The property is located on the north side of this RJW and PUE approximately three-quarters of a mile west
of the end of Calle Apache, and
WHEREAS, the site is vacant and has rolling terrain sloping toward the east. There are no
residences or development in the area, There are severa] washes and drainage areas that cross the property, ,
and
WHEREAS, the property owner proposes to split the 40-acre parcel into three five-plus-acre and
two ten-plus-acre parcels. There have been several splits in the area, The Sierra Vista Estates Subdivision
to the east contains parcels of five acres. The approved General Plan designates this to be a rural area, and
WHEREAS, review of FEMA FIRM Pane] #040058-2375B indicates this parcel to be in Zone C,
not in the FEMA Special Flood Hazard Area. A Floodplain Use Permit is not required, and
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
June 14, ] 995, the Commission recommended APPROVAL for a Rezone subject to the following:
1. The southern three parcels will be rezoned A-Rl5A (Agricu]tural-Residentia]/Five-Acre
Minimum Lot Size) and the northern two parcels will be rezoned A-Rl8A (Agricultural-
Residential/Eight-Acre Minimum Lot Size),

2, The submittal and recordation of a Parcel Pial prepared in accordance with Article 3.] 6 of
the Mohave County Subdivision Regulations and 102,04-B of the Standard Specifications
and Details is required.
3, That the Board of Supervisors accepts the dedication of the proposed 50-foot roadway right-
of-way to be named Ingersoll Lane, In addition, 20-foot radius curves are required at all
dedicated roadway intersection points,
4, That the Board of Supervisors accepts the granting of the eight feet adjacent to the road
rights-of-way as a Public Utilities Easement (PUE),
5, The dedications and grantings required by the Rezone resolution shall be shown on the Pareel
Plat and accepted by the Board of Supervisors upon Parcel Plat recordation,
6. Each parcel shall meet or exceed its respective acreage exclusive of roadways,
7, Each parcel shall have legal access.
8, The Parcel Plat shall show any surface drainage and FEMA flood zones,
9, The appropriate zoning, building, environmental and floodplain permits will be obtained
prior to any development. These permits will not be issued until Parcel Plat recordation,
10, The rezone shall not become effective for 30 days after final Board of Supervisors approval
for the change in classification, as per ARS I] -829E,
I 1. If these conditions are not met within one year this approval will be void, If at the expiration,
of this period the property has not been improved to meet the use for which it was
conditionally approved, the Board of Supervisors (after notification by registered mail to the
owner and applicant who requested the rezoning) shall schedule a public hearing to grant an
extension, determine compliance with the schedule for development, or cause the property
to revert to its former zoning classification, This action is in accordance with Arizona
Revised Statutes Annotated, Title 11, Chapter 6, 1] -832,
WHEREAS, the notice of hearing was published in the Kingman Dai]y Miner, a newspaper of
genera] circulation in Kingman, Mohave County, Arizona, June 18, 1995, and posted June 16, ]995, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations,

NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Wednesday, July 5, 1995, APPROVED this Rezone as recommended by the Mohave County Planning
and Zoning Commission and outlined herein,
