WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on July 5, ] 995, a public hearing was conducted to determine whether approval should be granted for a Rezone for the above described property as requested by Silver Ranch Corporation of Kingman, Arizona, and WHEREAS, the property is located south of Interstate 40 and Highway 93 about one mile south of the Interstate 40 and Highway 93 intersection, This property is accessed from Highway 93 and is on the southeast corner of Highway 93 and Crazy Horse Road, and WHEREAS, the site is vacant and has rolling terrain, rising moderately toward the south, There are no significant drainage patterns that cross the property. The surrounding property is vacant, and WHEREAS, the property owner proposes to rezone the northern 10 acres along Highway 93 of the 59,8-acre parcel so as to develop a service station and motel facilities on this site, The approved General Plan designates this to be a suburban area, and WHEREAS, review ofFEMA FIRM Panel #040058-2375B indicates this parcel to be in Zone C, not in the FEMA Special Flood Hazard Area, A F]oodplain Use Permit is not required, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on June 14, 1995, the Commission recommended APPROVAL for a Rezone subject to the following: 1. The northerly 10 acres of Parcel 12 will be rezoned C-2H (General Commercia] Highway Frontage) as shown on Exhibit "A", 2, The submittal and recordation of a Parcel Plat prepared in accordance with Article 3,16 of the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications and Detai]s is required, . . . . The applicant shall comply with all applicab]e provisions of the Mohave County Zoning Regulations, Section 27,P (Site Plan Requirements) mllst be completed and approved prior to approval of permits. 4, Concurrence from the Arizona Department of Transportation (ADOT) is required for the method of accessing Highway 93. 5. Crazy Horse Road will have to be improved as a paved roadway if it is to be utilized as a traffic access for this site, 6. The parcel shall have legal access, 7, The Parcel Plat shall show any surface drainage and FEMA flood zones, 8, The appropriate zoning, building, environmental and floodplain permits will be obtained prior to any development. These permits will not be issued until Parcel Plat recordation, 9, The rezone shall not become effective for 30 days after final Board of Supervisors approval for the change in classification, as per ARS 11-829E, 10, If these conditions are not met within one year this approval will be void, If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832, WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, June 18, 1995, and posted June 16, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations, NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Wednesday, Ju]y 5, 1995, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein, MOHA VE COUNTY BOARD OF SUPERVISORS ~~y~~ Pat Holt, Chairman Exhibit "A ".
