A RESOLUTION SETTING FORTH A SPECIFIC USE PERMIT ON THE NEY-. NEY-. NEY-. NEY-.
OF SECTION 21, EXCEPT THE NORTH 42 FEET, TOWNSHIP 14 NORTH, RANGE 20 WEST,
FOR A PROPANE STORAGE TANK IN AN M (GENERAL MANUFACTURING) ZONE, IN THE
LAKE HA V ASU CITY AREA, MOHA VE COUNTY, ARIZONA.
WHEREAS, at the special meeting ofthe Mohave County Board of Supervisors held on October
16, 1995, a public hearing was conducted to detennine whether a Specific Use Pennit should be granted for
the above described property as requested by E Z Stop Propane, being represented by Judith A. Darby,
President, of Lake Havasu City, Arizona, and
WHEREAS, this property is located east of Highway 95 and south of Chenoweth Road. The site
is accessed from Highway 95 via east on Chenoweth Road to the site. The site is located approximately one-
quarter mile east of Highway 95 on the southwest comer of Chenoweth Road and Victoria Farms Road. The
property is fenced and is being used for small propane tank storage. The terrain is sloping slightly to the
west toward the Colorado River. The surrounding land uses consist of a decorative rock yard to the west,
a sand and gravel operation to the east, and the property to the south and north is vacant. There are no
significant drainage patterns crossing the property, and
WHEREAS, the applicant proposes this Specific Use Permit to allow the storage of propane tanks,
truck parking and bulk propane storage up to 4000 gallons on this location, and
WHEREAS, a review ofFEMA FIRM Panel #040058-311 OB indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above captioned item:
a, All notices have been advertised and posted according to regulations.
b, The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain,
c. The neighboring area contains other like land uses similar to the above proposed action,
d. The site has legal access.
e There are no significant environmental features affecting the site.

WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
September 13. 1995, the Commission recommended APPROVAL for a Specific Use Permit subject to the
following:
1. This Specific Use Permit is intended for the storage of propane tanks, truck parking and bulk
propane storage up to 4000 gallons and activities related thereto; any new use will require
another Specific Use Permit.
2. The Specific Use Permit will commence upon the effective date of the rezone.
3. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior
to the approval of permits. The site plan must include a limited drainage report to mitigate
any additional drainage created by this development.
4. The appropriate zoning, building, environmental and floodplain permits will be obtained.
5, Approval of a Specific Use Permit, with such conditions and restrictions as the Board of
Supervisors may impose, shall be valid for two (2) years, in which time construction on the
project shall commence or the use authorized shall be initiated. Prior to expiration of the
approval, the developer may request an Extension of Time from the Commission to initiate
the project, and the Commission shall recommend to the Board an action based upon a
finding of substantial grounds of which to grant such an Extension of Time up to one (1)
year.
WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County, Arizona, September 17,1995, and posted September 15,
1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their special meeting
on Monday, October 16, 1995, APPROVED this Specific Use Permit as recommended by the Mohave
County Planning and Zoning Commission and outlined herein, with the addition of the following conditions:
6. The applicant comply with the requirements of the State Fire Marshal's office.
