A RESOLUTION SETTING FORTH A REZONE OF THE NE'I. NE'I. NE'I. NE'I. OF SECTION 21,
EXCEPT THE NORTH 42 FEET, TOWNSHIP 14 NORTH, RANGE 20 WEST, FROM C-M
(COl\1MERCIAL-MANUFACtUluNG) ZONE TO M (GENERAL MANUFACTURING) ZONE,
IN THE LAKE HA V ASU CITY AREA, MOHA VE COUNTY, ARIZONA.
WHEREAS, at the special meeting of the Mohave County Board of Supervisors held on October
16, 1995, a public hearing was conducted to determine whether approval should be granted to Rezone the
above described property as requested by E Z Stop Propane, being represented by Judith A. Darby,
President, of Lake Havasu City, Arizona, and
WHEREAS, this property is located east of Highway 95 and south of Chenoweth Road. The site
is accessed from Highway 95 via east on Chenoweth Road to the site. The site is located approximately one-
quarter mile east of Highway 95 on the southwest comer of Chenoweth Road and Victoria Farms Road. The
property is fenced and is being used for small propane tank storage. The terrain is sloping slightly to the
west toward the Colorado River. The surrounding land uses consist of a decorative rock yard to the west,
a sand and gravel operation to the east, and the property to the south and north is vacant. There are no
significant drainage patterns crossing the property, and
WHEREAS, the applicant proposes this zone change to allow the storage of propane tanks, truck
parking and bulk propane storage up to 4000 gallons on this location. The Mohave County General Plan
designates this area as an Urban Development Area, and
WHEREAS, the Mohave County Public Works Department states that, in their opinion, the 30-foot
roadway easement known as Chenoweth Road is not sufficient for ingress and egress to a commercial
project such as this one. The access road to this property is along a section line alignment. The minimum
county standards for a section line roadway is 84 feet. In addition, radius curves to accommodate truck
traffic onto State Route 95 should be a minimum of 45 feet. The developer needs to obtain adequate access
to this site in accordance with minimum county standards, and
WHEREAS, a review ofFEMA FIRM Panel #040058-311 OB indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above captioned item:
a. All notices have been advertised and posted according to regulations.

b. The proposed action and the effect on the property complies with the Mohave County
General Plan.
c, The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The neighboring area contains other like land uses similar to the above proposed action,
e. The site has legal access.
f. There are no significant environmental features affecting the site.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
September 13, 1995, the Commission recommended APPROVAL for a Rezone subject to the following:
I. This property will be rezoned M (General Manufacturing) and all uses will require a Specific
Use Permit.
2. The applicant will comply with the requirements of the State Fire Marshal's office.
3. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior
to the approval of permits. This must include a limited drainage report to mitigate any
additional drainage created by this development.
4. The Mohave County Public Works Department requires the minimum driveway width for
this site to be at least 24 feet wide with 45-foot radius curves at the driveway entrance to
Chenoweth Road.
5. The appropriate zoning, building, environmental and floodplain permits will be obtained.
6. The rezone shall not become effective until at least 30 days after final approval of the change
in classification by the Board of Supervisors, as per ARS 11-829E.
7. If these conditions are not met within one year this approval will be void. If at the expiration
of this period the property has not been improved to meet the use for which it was
conditionally approved, the Board of Supervisors (after notification by registered mail to the
owner and applicant who requested the rezoning) shall schedule a public hearing to grant an
extension, determine compliance with the schedule for development, or cause the property
to revert to its former zoning classification. This action is in accordance with Arizona
Revised Statutes Annotated, Title 11, Chapter 6, 11-832.
WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County, Arizona, September 17, 1995, and posted September IS,
1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.

NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their special meeting
on Monday, October 16, 1995, APPROVED this Rezone as recommended by the Mohave County Planning
and Zoning Commission and outlined herein.
