BOS RESOLUTION NO. 95-381 A RESOLUTION SETTING FORTH AN AMENDMENT OF SECTION 9 AND SECTION 27 OF THE MORAVE COUNTY ZONING REGULATIONS REGARDING OPEN LOT STORAGE PROVISIONS WHEREAS, at the September 18, 1995 Board of Supervisors meeting, the Mohave County Board of Supervisors held a public hearing on the proposed amendment; and WHEREAS, the Mohave County Zoning Regulations currently limit open storage of materials to a maximum of two hundred (200) square feet for lots not specifically zoned for such use; and WHEREAS,the Planning and Zoning Commission first heard a request to amend the open storage provisions at their April 8, 1992 meeting at the request of the People's Community Land Trust (pCL T); and WHEREAS, the Commission recommended to the Board that an amendment to the Mohave County regulations be adopted at their August 12, 1992 meeting; and WHEREAS, the Board of Supervisors considered the Commission's recommendation at their meeting on September 8, 1992 and referred the proposed amendment to a committee to "establish different zones"; and WHEREAS,the committee presented its findings to the Board at their meeting on April 19, 1993. The Board held a public hearing on May 17, 1993 and tabled the committee's recommendation until after the adoption of the General Plan; and WHEREAS, the Mohave County General Plan was adopted on March 10, 1995; and WHEREAS,the Planning and Zoning Commission held a public hearing at their meeting on July 12,1995 to consider amendments to the Mohave County Zoning Regulations and recommended to the Board of Supervisors the following amendments (wording to be deleted is strttek; wording to be added is bolded): - . . . Section 9: Junk Yards: The use ofmme ttlflll in excess of two hundred (200) square feet of the area of any lot one-half acre or less; five hundred (500) square feet for lots greater than one-half acre up to and including two (2) acres; one thousand (1,000) square feet for lots greater than two (2) acres up to and including three (3) acres; two thousand (2,000) square feet for lots greater than three (3) acres up to and including fIVe (5) acres; and two (2) percent of the lot for lots in excess of five (5) acres, not specifically zoned for such use for the keeping of junk. Junk includes tmIieensea unregistered or inoperable automobiles or portions of automobiles, old buildings, scrap metals, scrap wood (excluding wood use for heating purposes), or other scrap materials, appliances, and/or the dismantling or "wrecking" of automobiles or other vehicles or machinery or structures, but is not limited thereto. Section 27.H.: Add subsection 5: H. Fences. Hedges. and Similar Structures 5A. Except as stated in 5C below, the use of more than four hundred (400) square feet of the area of any lot having a principal residence or not specifically zoned for such use, for the storage or keeping of unregistered and inoperable autos or portions of autos, scrap metal, scrap wood (excluding wood for heating purposes), machinery shall have said storage screened. All such outdoor storage screened. All such outdoor storage shall be located to the rear of the property and screened from neighboring properties and roadways by a wall or non- transparent fencing. Said wall or fencing shall not exceed six (6) feet in height and shall be constructed of materials normally designed for fencing purposes. Stored materials shall not be visible above the required screening excluding large vehicles and stored mobile homes. ~ < , ~ . . RESOLUTION NO. 95-381 Page 3 5B. All storage on a vacant lot shall be screened in compliance with SA above. 5C. Lots thirty-six (36) acres or greater in size are exempt from the fencing and the location requirements in SA above. Storage on such lot shall be concentrated into one area and the storage that is visible from the nearest public roadway shall be screened. . Section 27.Q.: Add the following: 1. Lots five acres or less in size, outside storage of materials must comply with the setback requirements for ancillary structures. 2. Lots greater than five acres in size, outside storage of materials must comply with the following setbacks from all property boundaries: Amount of Storage Setbacks Less than 3000 sq. ft. 3000 - 3999 sq. ft. 4000 - 4999 sq. ft. 5000 sq. ft. or more Setbacks for ancillary structures 300 ft. 400 ft. 500 ft. WHEREAS, notices of the Board of Supervisors public hearing were published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, in the Mohave Valley News, Today's News-Herald, and The Daily Spectrum on September 3, 1995, and posted on September I, 1995, as required by Arizona Revised Statues and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED by the Mohave County Board of Supervisors that the Mohave County Zoning Regulations be amended as recommended by the Planning and Zoning Commission.
