AZ JOAM MC CALL, MOHAVE COUNTY RECORDER 09/06/95 03:30P PAGE 1 OF 2 MOHAVE COUNTY BOARD OF SUPERVISORS RECDRDING FEE 0.00 RESOLUTION NO. 95-378 A RESOLUTION SETTING FORTH A REZONE OF A PORTION OF THE WY> SWv.; OF SECTION 35, TOWNSHIP 21 NORTH, RANGE 17 WEST, FROM A (GENERAL) ZONE TO C-2H (GENERAL COMMERCIAL HIGHWAY FRONTAGE) ZONE, IN THE KINGMAN AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September 5, 1995, a public hearing was conducted to determine whether a Rezone should be granted for the above described property as requested by Arthur A. Arnold of Kingman, Arizona, and WHEREAS, the applicant proposes this zone change to erect a sign, This property is located south of Kingman, south ofInterstate 40, north of the McConnico exit. The site is accessed from Interstate 40 via south on the McConnico exit, then north on the Frontage Road to the site. The site is on the north side of the Frontage Road, also known as "Old Route 66", and WHEREAS, the applicant proposes to place an off-premise sign on this property. The Mohave County General Plan designates this area as an Urban Development Area. Mohave County Zoning Regulations, Section 31-8-D, Off-Premise Signs, states "It is the policy ofthe Board of Supervisors and Planning and Zoning Commission of Mohave County to permit off-premise signs to be located in viable commercial areas and to discourage the rezoning of lots and parcels for the sole purpose of installing off- premise signs," and WHEREAS, a review ofFEMA FIRM Panel #040058-2350C indicates the parcel described to be in Zone A, in the Special Flood Hazard Area, requiring a permit before any development, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect on the property are in conformance with the Mohave County General Plan; however, it does not comply with the County's off-premise sign policy as stated in the Mohave County Zoning Regulations, Section 31-8-D. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above proposed action. e, The site has legal access, f. There are no significant environmental features affecting the site. ,. . _. RESOLUTION NO. 95-378 PAGE 2 OF 2 Page 2 BK 2618 PG 649 FEE~95047015 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on August 9, 1995, the Commission recommended DENIAL for a Rezone based upon the following: 1. The request does not comply with Section 31-8-D of the Mohave County Zoning Regulations. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, August 20,1995, and posted August 18, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, September 5, 1995, DENIED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
