WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September 5, 1995, a public hearing was conducted to determine whether an Extension of Time should be granted as requested by Daniel J. Courselle of Kingman, Arizona, and WHEREAS, the subdivision is located south of Jagerson A venue and east of College Drive, The site can be accessed directly from Jagerson Avenue, and WHEREAS, the Preliminary Plan for this tract was approved by the Mohave County Board of Supervisors on December 2,1991, per Bas Resolution No. 91-330. The first Extension of Time was due on December 2,1993, and WHEREAS, the surrounding land uses consist of single-family residential subdivision to the south, a church to the east, Mohave Community College to the north and vacant land to the west, and WHEREAS, the Preliminary Plan depicts 14-plus acres subdivided into 31 multiple-family lots, ranging in size from 9,000 square feet to 10,670 square feet, and WHEREAS, because there was no action on this subdivision, staff initiated a rescission of the approval of this subdivision. The owner of the property requested that this rescission be removed from the Planning and Zoning Commission agenda to permit a formal request for an extension, and WHEREAS, a letter dated June 4, 1995, from Daniel Courselle is quoted as follows: "The market for a multiple family project has been very slow to develop, both from a lender and buyer side in this area. We have not been inspired to speed-up the process also, due to the slow growth of our other properties in Kingman, which are under construction. I was in contact with South Pointe Consultants, our Engineer of Record, in March 1994. In August, I went to their office in Bullhead and was surprised to find they had closed shop. Finally, I contacted a California firm which purchased South Pointe and now have a letter releasing me to choose any other authorized firm to represent the development on my behalf with the County. In November last year I agreed with Herb Shipley, a Civil Engineer, to take over where South Pointe left off. Herb's business and personal matters (his wife has been seriously ill), were getting to be too much for him so in March of this year we agreed that I contact another firm and he would bring that new firm current as to what has to be done. I am now talking with Stovall Engineering who will probably be the new Engineer-of-Record. I am also working with an eastern lender at the present time to build all 31 four-plexes rather than phasing the development into two segments as originally planned. The market for rentals is getting much better and hopefully will grow from here", and WHEREAS, the Mohave County Public Works Department requires compliance with current requirements, compatibility with drainage and circulation patterns of recent nearby development, and WHEREAS, this will be the second Extension of Time, and WHEREAS, the following are Findings of Fact for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action complies with the Mohave County General Plan, and the property is designated as an Urban Development Area. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses. d. This request for an extension complies with the Extension of Time Policy. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on August 9, 1995, the Commission recommended APPROVAL for an Extension of Time subject to the following: 1. Compliance with all conditions ofBOS Resolution No 91-330. 2. This Extension of Time will be in effect until December 2,1996. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, August 20,1995, and posted August 18, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations,
