WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September 5, 1995, a public hearing was conducted to determine whether approval should be granted for an Amendment to the Board of Supervisors Resolution No. 92-195 setting forth a Rezone for the above described property as requested by Darryl Smith of Kingman, Arizona, and WHEREAS, the language to be added has been bolded and the language to be deleted has been 8tnIek, and WHEREAS, this amendment is to delete conditions which are no longer applicable under current zoning regulations and to approve an alternate engineered fence design that was administratively approved by the previous director, James Neblett. The property is located southwest of the City of Kingman, between Interstate 40 and the AT&SF rail line south of the Oatman-McConnico interchange. The property is accessed from Interstate 40 via the Oatman-McConnico interchange, then east to the Frontage Road, then south on the Frontage Road to the property, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on August 9, 1995, the Commission recommended APPROVAL for the proposed Amendment to Board of Supervisors Resolution No, 92-195 setting forth a Rezone subject to the following: 1. The applicant comply with all applicable provisions of Sections 25, 26, 27, and 31 of the Mohave County Zoning Regulations. Compliance with Section 27.P (Site Plan Requirements) and Ordinance 87-1 (Dark Sky Ordinance) is also required. 2. The applicant comply with all applicable provision of Section 23 (Regulations for General Manufacturing or "M" Zone) of the Mohave County Zoning Regulations. .!-. .~ . . NOTE: THE FOLLOWING 5 ITEMS APPLY TO TRANSPORTATION RELATED REQUIREMENTS. 6 4. Adequate parking shall be implemented in accordance with Section 26 of the Mohave County Zoning Ordnance. '1- 5. A one (l) foot vehicle non-access easement shall be established along the west boundary of this parcel contiguous to Interstate 40's eastern right-of-way exce,pt for approved access points. The paving of the aforementioned roads shall be in accordance with Mohave County Standards IOl.lOA or better and shall be placed on the center-line of roadway rights-of-waYll in a width and design as approved by the County Engineer and coordination with ADOT for access to Interstate 40. M 8. The applicant obtain required DOT permits for access to Interstate 40 if applicable. NOTE: THE FOLLOWING ITEMS APPLY TO GENERAL REQUIREMENTS. H 9. That appropriate zoninglbuilding/environmental permits be obtained. H 10. That a buffer, in the form ofan eight (8') foot block wall, shall be required along the AT&SF boundary. Any remainder of the lot not used for development shall be maintained free of debris and vegetation controlled to minimize potential fire hazards. Grasses/weeds shall be cut regularly to assure less than eight (8"0) inches of growth. If crushed rock is used then the soil shall be maintained in a weed free condition. +4 12. Any permitted open lot storage must be related to or be an accessory to the primary business. The storage area shall be covered with a dust-proof surface. If crushed rock is used for the dust-proof surface then the soil shall be maintained in a weed free condition. Any open lot storage shall be completely enclosed by a view-obscuring fence which extends two (2') feet above the highest item to be stored, with a minimum of six (6') feet and a maximum of eight (8') feet in height. No open lot storage materials shall be stacked higher than the fence. Fencing shall display no advertising. +513. The rezone shall not become effective for at least thirty (30) days after final approval of the change in classification by the Board of Supervisors, Being JIll) 2, 1992, as per ARS 11- 829E. f614. If these conditions are not met within one (I) year this approval shall be void. If at the expiration of this period the property has not been improved for the use for which it was conditionally approved, the Board after notification by registered mail to the owner and applicant who requested the rezoning shall schedule a public hearing to grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, August 20, 1995, and posted August 18, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
