NEY. OF SECTION 1, TOWNSHIP 23 NORTH, RANGE 17 WEST, FROM A-R/36A (AGRICULTURAL- RESIDENTIALrrHIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE TO A-R/I0A AND A-R/5A (AGRICULTURAL-RESIDENTIALrrEN ACRE AND FIVE ACRE MINIMUM LOT SIZE) ZONES, IN THE MOHA VE COUNTY GENERAL AREA, MORAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September 5, 1995, a public hearing was conducted to determine whether a Rezone should be granted for the above described property as requested by R. W. Holmquist & Associates of Kingman, Arizona, representing Merlen Kage of Dewey, Arizona and Steve and Saundra Cavendar of Sonoita, Arizona, and WHEREAS, this property is located north of Kingman, west of Stockton Hill Road. The property is accessed from Kingman via north on Stockton Hill Road to FalconValley Road, then west approximately one-quarter mile on Falcon Valley Road to the property. The site is located on the northwest comer of Webb Road and FalconValley Road, and WHEREAS, the applicant proposes to divide the 40.50-acre property into three 5-plus-acre parcels and two II-plus-acre parcels. The Mohave County General Plan designates this area as a Rural Development Area. The property is vacant and the terrain gently rolling in the southeast portion; however, the northeast portion of the property slopes sharply upward, There are no significant drainage patterns that cross the property, and WHEREAS, a review ofFEMA FIRM Panel #040058-2000B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area. A Floodplain Use Permit is not required. Development may not obstruct washes on the parcel, and WHEREAS, the following described Findings of Fact are for the above captioned item: a, All notices have been advertised and posted according to regulations. b. The proposed action and the effect on the property complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d, The site has legal access, e. There are no significant environmental features affecting the site. RESOLUTION NO. 95-374 Page 2 . . PAGE 2 OF J BK 2618 PG 637 FEE~95047011 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on August 9, 1995, the Commission recommended APPROVAL for a Rezone subject to the following: 1. The northern two parcels will be rezoned A-R/IOA (Agricultural-Residentialrren Acre Minimum Lot Size) and the southern three parcels fronting on Falcon Valley Road will be rezoned A-R/5A (Agricultural-ResidentiallFive Acre Minimum Lot Size). 2. The submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications and Details is required. 3. That the Board of Supervisors accepts the dedication of the existing 50-foot roadway easement known as Falcon Valley Road and the existing 50-foot roadway easement known as Webb Road as roadway rights-of-way. Also, the Board of Supervisors accepts the dedication of the proposed 50-foot wide cul-de-sac and its 50-foot radius, hammerhead terminus bulb. In addition, 20-foot radius curves are required at all dedicated roadway intersection points. 4. That the Board of Supervisors accepts the granting of the eight feet adjacent to all rights-of- way. Citizens Utilities Company requests an additional two feet for a total of a 10- foot easement along the west side ofthe cul-de-sac road as Public Utilities Easements (PUBs). 5. The dedications and grantings required by the Rezone resolution shall be shown on the Parcel Plat and accepted by the Board of Supervisors upon Parcel Plat recordation. 6. Each parcel shall meet or exceed its respective acreage exclusive of roadways. 7. Each parcel shall have legal access. 8. The Parcel Plat shall show any surface drainage and FEMA flood zones. 9. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. 10. The rezone shall not become effective for at least 30 days after final Board of Supervisors approval for the change in classification, as per ARS 11-829E. RESOLUTION NO. 95-374 Page 3 . . PAGE 3 OF J BK 2618 PG 638 FEE~95047011 II. If these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, August 20,1995, and posted August 18,1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, September 5, 1995, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
