RESOLUTION NO. 95-372
A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON GATEWAY ACRES, TRACT
10, THAT PORTION OF LOT 74 LYING WESTERLY OF HIGHWAY 93, iN SECTION 19,
TOWNSHIP 25 NORTH, RANGE 19 WEST, FOR AN OFF-PREMISE SIGN IN A C-2H
(GENERAL COMMERCIAL HIGHWAY FRONTAGE) ZONE, IN THE MOHAVE COUNTY
GENERAL AREA, MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on January
2, 1996, a public hearing was conducted to determine whether a Zoning Use Permit should be approved for
the above described property as requested by Lucretia M. Langham ofY oung Electric Sign Company of Las
Vegas, Nevada, representing the owners William 1. and Carol Sue Jones and Charles and Leslie Coffey of
Kingman, Arizona, and
WHEREAS, this property is located on the west side of Highway 93, about one-half mile north of
the intersection of Highway 93 and Pierce Ferry Road. The site is accessed from Highway 93. A tourist
souvenir shop/deli and real estate office is on the property, and
WHEREAS, the proposed location meets the zoning and spacing requirements for rn off-premise
sign. The Arizona Department of Transportation (ADOT) requires the off-premise sign to . ., 'cd within
1,000 feet of an established commercial business, and
WHEREAS, the applicant proposes to place an off-premise advertising sign on this property. The
Mohave County General Plan designates this area as a Rural Development Area and this portion of Highway
93 as a Scenic Route, and
WHEREAS, the surrounding uses consist of vacant land, The property is relatively flat with no
significant drainage patterns crossing the site, and
WHEREAS, a review ofFEMA FIRM Panel #040058-1775B indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, this item was heard by the Planning and Zoning Commission on August 9, 1995, and
the Commission recommended approval. At the Board of Supervisors meeting on September 5, 1995, this
item was continued until the zoning was approved. On October 16, 1995, the Board of Supervisors
approved the zoning for this property but stipulated in BOS Resolution No. 95-371 that an off-premise sign
would not be allowed, and

WHEREAS, the following described Findings of Fact are for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and the effect does not comply with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The neighboring area contains other like land uses similar to the above proposed action.
e. The site has legal access.
f. There are no significant environmental features affecting the site.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
December 13, 1995, the Commission recommended DENIAL for a Zoning Use Permit based upon the
following:
1. The Board of Supervisors Resolution No. 95-371 dated October 16, 1995, stated that an off-
premise sign will not be allowed on this property.
2. This sign location is on a Scenic Route as designated by the Mohave County General Plan.
WHEREAS, the notice of hearing was published in the Kingman Daily Miner;'lt-newspaper of
general circulation in Kingman, Mohave County, Arizona, December 17, 1995, and posted December 18,
1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Tuesday, January 2, 1996, DENIED this Zoning Use Permit as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
