WHEREAS, at the special meeting of the Mohave County Board of Supervisors held on October 16, 1995, a public hearing was conducted to determine whether approval should be granted to Rezone the above described property as requested by Lucretia M. Langham of Young Electric Sign Company of Las Vegas, Nevada, representing the owners William J. and Carol Sue Jones and Charles and Leslie Coffey of Kingman, Arizona, and WHEREAS, this property is located on the west side of Highway 93, about one-half mile north of the intersection of Highway 93 and Pierce Ferry Road. The site is accessed from Highway 93, and WHEREAS, this Rezone request is to allow for commercial development. A tourist souvenir shop/deli and real estate office is on the property. The Mohave County General Plan designates this area as a Rural Development Area, and WHEREAS, the surrounding use consists of vacant land. The property is relatively flat with no significant drainage patterns crossing the site, and WHEREAS, in accordance with Mohave County Zoning Regulations, Section 3I-8-D, Off-Premise Signs, "It is the policy of the Board of Supervisors and Planning and Zoning Commission of Mohave County to permit off-premise signs to be located in viable commercial areas and to discourage the rezoning oflots and parcels for the sole purpose of installing off-premise signs," and WHEREAS, a review ofFEMA FIRM Panel #040058-1775B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area. A Floodplain Use Permit is not required, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect on the property are in conformance with the Mohave County General Plan. RESOLUTION NO. 95-371 Page 2 ;- ~ . . c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on August 9, 1995, the Commission recommended APPROVAL for a Rezone subject to the following: 1. This property will be rezoned C-2H/3A (General Commercial Highway FrontagefThree Acre Minimum Lot Size). 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits. 3. The appropriate zoning, building, environmental and floodplain permits will be obtained. 4. The rezone shall not become effective until at least 30 days after fmal approval of the change in classification by the Board of Supervisors, as per ARS 11-829E. 5. If these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6,11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, October I, 1995, and posted September 29, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their special meeting on Monday, October 16,1995, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein, with the addition of the following condition: :.\\\\\\\\Ilhll/III//f/"No off-premise signs be approved. #'\\~ t.\1..
