RESOLUTION NO. 95-368 A RESOLUTION SETTING FORTH A REZONE OF SACRAMENTO V ALLEY RANCHES, THE SY. OF PARCEL 67, IN THE SWYO SEYO OF SECTION 18, TOWNSHIP 21 NORTH, RANGE 18 WEST, FROM A-RlI0A (AGRICULTURAL-RESIDENTIALrrEN ACRE MINIMUM LOT SIZE) ZONE TO A-Rl8A AND A-Rl2A (AGRICULTURAL-RESIDENTIALIEIGHT ACRE AND TWO ACRE MINIMUM LOT SIZE) ZONES, IN THE GOLDEN VALLEY AREA, MORAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September 5, 1995, a public hearing was conducted to determine whether a Rezone should be granted for the above described property as requested by R. W. Holmquist & Associates of Kingman, Arizona, representing Roy and Joann Corder of San Diego, California, and WHEREAS, this property is located south of Highway 68 between Colorado Road and Teddy Roosevelt Road. The property is accessed from Highway 68 via south on Colorado Road to Redwall Drive, then west approximately one-quarter mile on Redwall Drive. The site is located on the northwest comer of Lochiel Road and Redwall Drive, and WHEREAS, the applicant proposes to divide the I9.99-acre property into four 2-plus-acre parcels and one 8-plus-acre parcel. The Mohave County General Plan designates this area an Urban Development Area. Similar land divisions have occurred in the area. The surrounding land uses are similar to the proposed action. The property is vacant and terrain is generally flat. There are no significant drainage patterns that cross the property, and WHEREAS, a review ofFEMA FIRM Panel #040058-2325B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area. A Floodplain Use Permit is not required, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect on the property complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e, There are no significant environmental features affecting the site. ~ - . . RESOLUTION NO. 95-368 Page 2 PAGE 2 OF 3 BK 2618 PG 626 FEE~95047007 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on August 9, 1995, the Commission recommended APPROVAL for a Rezone subject to the following: I. The western parcel will be rezoned A-Rl8A (Agricultural-Residential/Eight Acre Minimum Lot Size) and the four eastern parcels will be rezoned A-Rl2A (Agricultural-Residentialffwo Acre Minimum Lot Size). 2. The submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications and Details is required. 3. That the Board of Supervisors accepts the dedication of the existing 50-foot roadway easement known as Redwall Drive, the existing 35-foot roadway easement known as Ligurta Road, and the existing 30-foot roadway easement known as Lochiel Road as roadway rights- of-way. Also, the Board of Supervisors accepts the dedication of the proposed 50-foot wide cul-de-sac with a 45-foot radius terminus bulb. In addition, 20-foot radius curves are required at all dedicated roadway intersection points. 4. That the Board of Supervisors accepts the granting of the eight feet adjacent to all rights-of- way. Citizens Utilities Company requests an additional guy wire easement at the west end of the cul-de-sac, splitting the property line between the two rear lots as Public Utilities Easements (PUEs). 5. The dedications and grantings required by the Rezone resolution shall be shown on the Parcel Plat and accepted by the Board of Supervisors upon Parcel Plat recordation. 6. Each parcel shall meet or exceed its respective acreage exclusive of roadways. 7. Each parcel shall have legal access. 8. The Parcel Plat shall show any surface drainage and FEMA flood zones. 9. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. 10. The rezone shall not become effective for at least 30 days after final Board of Supervisors approval for the change in classification, as per ARS 11-829E. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title II, Chapter 6,11-832. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, August 20,1995, and posted August 18, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, September 5, 1995, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
