A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON FAIRWAY ESTATES, PRASE
I, AMENDED, TRACT 4097-A, BLOCK A, LOT 1, IN SECTION 35, TOWNSHIP 19 NORTH,
RANGE 22 WEST, FOR A SALES OFFICE IN A MODEL HOME, IN A R-SD (RESIDENTIAU
SPECIAL DEVELOPMENT) ZONE, IN THE SOUTH MOHA VE V ALLEY AREA, MORAVE
COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September
5, 1995, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for
the above described property as requested by Fairway Constructors, Inc., being represented by Mehdi
Azarmi, Bullhead City, Arizona, and
WHEREAS, this property is located east of Highway 95 and south of Joy Lane in the South Mohave
Valley. The site is accessed from Highway 95 via east on Joy Lane to South Club House Drive, then south
on South Club House Drive. The site is on the east side of South Club House Drive, and
WHEREAS, the proposal is to allow a sales office in the model home on this lot for home sales in
the Fairway Estates Subdivision. The property is flat and has a model home on it. The surrounding uses
include other model homes and single-family homes in different stages of construction. The Mohave
County General Plan designates this area as an Urban Development Area, and
WHEREAS, a review ofFEMA FIRM Panel #040058-2445C indicates the parcel described to be
in Zone A, in the Special Flood Hazard Area, requiring a permit before any development, and
WHEREAS, the following described Findings of Fact are for the above captioned item:
a. All notices have been advertised and posted according to regulations,
b. The proposed action and the effect on the property are in concurrence with the Mohave
County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The neighboring area contains other like land uses that are compatible to the above proposed
action.
e. The site has legal access.
f. There are no significant environmental features or problems affecting the site.

WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
August 9, 1995, the Commission recommended APPROVAL for a Zoning Use Permit subject to the
following:
I. The Zoning Use Permit will expire upon the sale of the model home.
2. The sale ofhomesllots from this office will be limited only to homesllots within the Fairway
Estates Subdivision.
3. The appropriate zoning, building, environmental and floodplain permits will be obtained.
4. If construction or use has not commenced within one year of Board approval of the Zoning
Use Permit or if the use has been discontinued for six months, then approval shall terminate
at that date.
5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of
Supervisors if, in the opinion of the Commission and Board, the continued use of the
property would be contrary to the public health, safety and welfare.
WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County, Arizona, August 20,1995, and posted August 18, 1995,
as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Tuesday, September 5, 1995, APPROVED this Zoning Use Permit as recommended by the Mohave
County Planning and Zoning Commission and outlined herein.
