SWv. SECTION 23, TOWNSHIP 19 NORTH, RANGE 22 WEST, IN THE SOUTH MOHA VE VALLEY AREA, MORAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September 5, 1995, a public hearing was conducted to determine whether approval from the Board of Supervisors for a Preliminary Subdivision Plan and a Final Subdivision Plan should be rescinded, and WHEREAS, the resolution which approved this subdivision indicates the developer of this tract was Michael Reagan and Associates, Cedar City, Utah. The engineer ofrecord is noted as Jack L. Stovall, P.E., of Bullhead City, Arizona, and WHEREAS, the subdivision is located east of Highway 95, south of Aztec Road and north of the EI Rodeo Drainage Channel. The Preliminary Plan depicted approximately 5-plus acres subdivided into 463 townhome lots, and WHEREAS, the Preliminary Plan for this tract was approved by the Mohave County Board of Supervisors on October 14, 1987, per P&ZC Resolution No. 87-176. A Final Plan for this tract was approved by the Mohave County Board of Supervisors on December 17, 1990, per BOS Resolution No. 90- 385, and WHEREAS, the first Extension of Time was granted on February 5, 1990, per BOS Resolution No. 90-40. An application for a second extension was due on February 5,1991; the third was due on February 5, 1992; the fourth was due on February 5,1993; the fifth was due on February 5,1994; and the sixth extension was due on February 5, 1995, which would have brought the subdivision current. No Extensions of Time have been requested by the owner since the original. Letters have been sent to the owner notifying them that approval of their subdivision expired, and an Extension of Time was required. There has been no response to the Planning and Zoning Department's inquiries, and WHEREAS, the following are Findings of Fact for the above captioned item: ~ -- . . The proposed action complies with the Mohave County Extension of Time Policy. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on August 9,1995, the Commission recommended APPROVAL for a rescission subject to the following: I. That P&ZC Resolution No. 87-176 and BOS Resolution No. 90-385 be rescinded. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, August 20, 1995, and posted August 18, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, September 5, 1995, APPROVED this rescission as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
