MICRomtB ~~004 81( 2618 PG 619 OFFICIAL RECORDS or MOHAVE COUNTY, AZ JOAN MC CALL, MOHAVE COUNTY RECDRDER 09/06/95 03:25P PAGE 1 OF 2 MOHAVE COUNTY BDARD OF SUPERVISORS REORDIHG FEE 0.00 RESOLUTION NO. 95-365 A RESOLUTION SETTING FORTH A RESCISSION OF BOS RESOLUTION NOS. 90-84 AND 90-85 WHICH APPROVED THE PRELIMINARY SUBDIVISION PLAN AND REZONING FOR JOY LANE PLAZA, TRACT 4098, A RE-SUBDIVISION OF LOTS 8 AND 16, BLOCK A, FORT MOHA VE MESA RANCHOS, BEING THE SYZ SECTION 26, TOWNSHIP 19 NORTH, RANGE 22 WEST, IN THE SOUTH MOHA VE VALLEY AREA, MORAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September 5, 1995, a public hearing was conducted to determine whether approval from the Board of Supervisors for a Preliminary Subdivision Plan and Rezone should be rescinded, and WHEREAS, the resolution which approved this subdivision indicates the developer of this tract was Dennis Gootrad, Westlake Village, California. The engineer of record is noted as Stovall Engineers, Inc., Bullhead City, Arizona, and WHEREAS, the subdivision is located east of Highway 95 and north of Joy Lane. The Prelirninary Plan depicted approximately 8-plus acres subdivided into 13 commercial lots, and WHEREAS, the Preliminary Plan for this tract was approved by the Mohave County Board of Supervisors on April 2, 1990, per BOS Resolution No. 90-84. The property was rezoned per BOS Resolution No. 90-85, and WHEREAS, the first Extension ofTirne was granted on March 9, 1992, per BOS Resolution No. 92-61. The second extension was due on March 9,1993, and the third extension on March 9,1994, which would have brought the subdivision current. No additional Extensions of Time have been requested by the owner. Letters have been sent to the owner notifying them that approval of their subdivision expired, and an Extension ofTirne was required. There has been no response to the Planning and Zoning Department's inquiries, and WHEREAS, the following are Findings of Fact for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action complies with the Mohave County Extension of Time Policy, WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on August 9, 1995, the Commission recommended APPROVAL for a rescission subject to the following: RESOLUTION NO. 95-365 PAGE 2 OF 2 BK 2618 PG 620 Page 2 FEEt95047004- -,- . . I. That BOS Resolution Nos. 90-84 and 90-85 be rescinded. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, August 20,1995, and posted August 18, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, September 5, 1995, APPROVED this rescission as recommended by the Mohave County Planning and Zoning Commission and outlined herein, MOHA VE COUNTY BOARD OF SUPERVISORS ~~~ Pat Holt, Chairman . -"-
