RESOLUTION NO. 95-364
A RESOLUTION SETTING FORTH A RESCISSION OF BOS RESOLUTION NOS. 91-7 AND 91-
J.Y WHICH APPROVED THE PRELIMINARY SUBDIVISION PLAN AND REZONING FOR
DESERT ARROYO, TRACT 4116, BEING A PORTION OF THE WYZ OF SECTION 7,
TOWNSHIP 17 NORTH, RANGE 21 WEST, IN THE SOUTH MOHA VE V ALLEY AREA,
MORAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September
5, 1995, a public hearing was conducted to determine whether approval from the Board of Supervisors for
a Preliminary Subdivision Plan and Rezone should be rescinded, and
WHEREAS, the resolution which approved this subdivision indicates the developer of this tract is
Desert Arroyo Incorporated, Los Angeles, California. The engineer of record is noted as Ace Engineering,
Bullhead City, Arizona, and
WHEREAS, the subdivision is located east of Highway 95 and north of Courtwright Road. The
Preliminary Plan depicted approximately 300 acres subdivided into 1,227 single-family lots, 55 multiple-
family lots, 31 commercial lots, and a drainage and park parcel, and
WHEREAS, the Preliminary Plan for this tract was approved by the Mohave County Board of
Supervisors on January 7, 1991, per BOS Resolution No. 91-7. The property was rezoned per BOS
Resolution No. 91-36, and
WHEREAS, the first Extension of Time was due on January 7,1993, the second extension on
January 7, 1994, and the third extension on January 7, 1995, which would have brought the subdivision
current. No Extensions of Time have been requested by the owner. Letters have been sent to the owner
notifying them that approval of their subdivision has expired, and an Extension of Time was required. There
has been no response to the Planning and Zoning Department's inquiries, and
WHEREAS, a letter dated April 11, 1995, from Terrence S. Leek quotes the following: "We have
completed forfeiture of the above described 1/2 Section and wish to have a period of time in which to review
the subdivision proceeding and determine if the new owners wish to continue the same. I would request a
60 day continuance of this matter so we may have an opportunity to review the same", and

WHEREAS, another letter from Mr. Leek stated: "I represent T-H-L Partners, owner of the
beneficial interest of the above captioned tract. We would like to request that Board of Supervisor
Resolutions No. 91-7 and 91-36 be extended for a period of nine (9) months. I would request you put this
item on the Planning and Zoning Department Agenda at a convenient time and advise me thereof', and
WHEREAS, there has been adequate time to bring this subdivision to current status. The
requirements for an Extension of Time have not been met. Until fees are paid and a request letter has been
submitted, the department recommends that no further extensions of this project be granted, and
WHEREAS, this item was originally scheduled for the April P&Z meeting but was continued at the
request of Mr. Leek. Since that request was submitted, no fees or other requirements for an extension have
been submitted, and
WHEREAS, the following are Findings of Fact for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action complies with the Mohave County Extension of Time Policy.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
August 9,1995, the Commission recommended APPROVAL for a rescission subject to the following:
1. That BOS Resolution Nos. 91-7 and 91-36 be rescinded.
WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County, Arizona, August 20, 1995, and posted August 18, 1995,
as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Tuesday, September 5, 1995, APPROVED this rescission as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
