HomeMy WebLinkAbout95-362 J -. t] ({)o . . -t\lCROf\1LIED lNOEXI:1f 9504- 7001 BK 2618 PG 613 OFICIAL RECORDS OF MOHAVE COUNTY, AZ JOAN MC CALL, MOHAVE COUNTY RECORDER 09/06/95 03:2~P PAGE 1 OF 2 HOHAVE COUNTY BDARD OF SUPERVISORS REORDING FEE 0.00 RESOLUTION NO. 95-362 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR THE APPROVED PRELIMINARY SUBDIVISION PLAN FOR SUN VALLEY ESTATES, TRACT 4064, BEING A SUBDIVISION OF A PORTION OF THE SEl4 OF SECTION 36, TOWNSHIP 19 NORTH, RANGE 22 WEST, AND THE NEl4 OF SECTION 1, TOWNSHIP 18 NORTH, RANGE 22 WEST, IN THE SOUTH MORA VE VALLEY AREA, MORAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September 5,1995, a public hearing was conducted to determine whether an Extension of Time should be granted as requested by representative G. Kelly Grier of Stovall Engineers, Inc. of Bullhead City, Arizona, and WHEREAS, the subdivision is located east of Highway 95 and south of Lipan Boulevard. The property is accessed from Highway 95 via Lipan Boulevard, then east to the site, and WHEREAS, the surrounding land uses consist of single-family residential subdivisions and vacant land. The eastern portion of the subdivision, or Phase A, has been recorded and improved. There are a number of homes that have been built in Phase A, and WHEREAS, the Preliminary Plan depicts 160 acres subdivided into 340 single-family lots, with an average lot size of 8,000 square feet. The Mohave County General Plan designates this area as Urban Development Area. The engineer of record for the subdivision is Stovall Engineers Inc. of Bullhead City, Arizona, and WHEREAS, a letter dated May 3, 1995, from Stovall Engineers requests a second Extension of Time on behalf of McCormick Development Company, the owner/developer of Sun Valley. The letter also notes that the Final Plat for Phase A has been recorded; Phase B is currently being prepared for re-submittal, and WHEREAS, the Mohave County Public Works Department requires compliance with current requirements, compatibility with drainage and circulation patterns of recent nearby development, and WHEREAS, the Preliminary Plan for this tract was approved by the Mohave County Board of Supervisors on May I, 1991, per BOS Resolution No. 91-118. The first Extension of Time was granted on May 3,1993, per BOS Resolution No. 93-117; the second Extension of Time was granted on July 5,1994, per BOS Resolution No. 94-208. Article 3.10-1 states, "Upon application to the commission and prior to RESOLUTION NO. 95-362 PAGE 2 OF 2 P 2 8K 2618 PG 61~ FEE~9S0~7001 age --- . . the expiration of the time limit, extensions in increments of one (1) year may be granted by the Board if the subdivider is actively processing the Final Plat. If such action is not taken then all proceedings relating to the plat shall be terminated", and WHEREAS, this will be the third Extension of Time, and WHEREAS, the following are Findings of Fact for the above captioned item: a, All notices have been advertised and posted according to regulations. b. The proposed action complies with the Mohave County General Plan, and the property is designated as an Urban Development Area. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses. d. This request for an extension complies with the Extension of Time Policy. e. Phase A of the subdivision has been recorded and improved, WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on August 9, 1995, the Commission recommended APPROVAL for an Extension of Time subject to the following: 1. Compliance with all conditions ofBOS Resolution Nos. 91-118, 93-117 and 94-208. 2, This Extension of Time will be in effect until May 1, 1996. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, August 20, 1995, and posted August 18, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, September 5, 1995, APPROVED this Extension of Time as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
