RESOLUTION NO. 95-361 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR A ZONING USE PERMIT ON A PORTION OF THE NY. SEV. OF SECTION 21, TOWNSHIP 14 NORTH, RANGE 20 WEST, FOR A RECREATIONAL VEHICLE (RV) PARK IN A C-2 (GENERAL COMMERCIAL) ZONE, IN THE LAKE HA V ASU CITY AREA, MORAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September 5, 1995, a public hearing was conducted to determine whether an Extension of Time for a Zoning Use Permit should be granted for the above described property as requested by Havasu Falls Partnership of Upland, California, and WHEREAS, the Recreational Vehicle Park will be located on approximately 9.33 acres and will include an associate manager's office/apartment and clubhouse. The surrounding land uses include a mobile home subdivision to the south and west, and a subdivision to the north. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, the property is located west of Highway 95 and north of Lake Drive and is accessed from Highway 95. The property is vacant and no improvements have been made in connection with the Recreational Vehicle Park, and WHEREAS, this Zoning Use Permit was conditionally approved by the Mohave County Board of Supervisors on February 3, 1992 per BOS Resolution No. 92-26. The first Extension of Time was granted on June 7,1993 via BOS Resolution No. 93-151, and the second Extension of Time was granted via BOS Resolution 94-103 on April 4, 1994, and WHEREAS, the applicant requested in a letter dated July 5, 1995, that the Zoning Use Permit be extended for one year. The letter stated: "We have recently acquired a partner who is very interested in our project and is ready to move forward. Weare very excited about this new partnership and remain committed to creating a project that not only the community but also the county will be proud of," and WHEREAS, this will be the third Extension of Time for this property. The approved Extension of Time Policy recommends that the maximum number of extensions will be two when the developer is actively pursuing a schedule of completion; it recommends only one extension for change of ownership or adverse economic conditions, and WHEREAS, a review ofFEMA FIRM Panel #040058-2000B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area. A Floodplain Use Permit is not required, and RESOLUTION NO. 95-361 Page 2 -. . . . PAGE 2 OF 2 BK 2618 PG 612 FEE~95047000 WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect on the property are in conformance with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d, The neighboring area contains other like land uses similar to the above proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site. g. This request does not conform to the Mohave County Extension of Time Policy. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on August 9, 1995, the Commission recommended APPROVAL for an Extension of Time for a Zoning Use Permit subject to the following: 1. Continued compliance with the conditions ofBOS Resolution Nos. 92-26 and 93-151. 2. This Extension of Time will be in effect until June 7, 1996. WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, August 20,1995, and posted August 18, 1995, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, September 5, 1995, APPROVED this Extension of Time for a Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
