A RESOLUTION SETTING FORTH A REZONE OF THE EAST 495 FEET OF THE SOUTH 528
FEET OF THE NE'I. NE'I. OF SECTION 21, TOWNSHIP 39 NORTH, RANGE 16 WEST, FROM
A-RlIA (AGRICULTURAL-RESIDENTIAL/ONE ACRE MINIMUM LOT SIZE) ZONE TO R-E/IA
(RESIDENTIAL-RECREATION/ONE ACRE MINIMUM LOT SIZE) ZONE, IN THE ARIZONA
STRIP AREA, MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on November
6, 1995, a public hearing was conducted to determine whether approval should be granted to Rezone the
above described property as requested by Mary Ann Murphy and Jesse K. Alger of Mesquite, Nevada, and
WHEREAS, this property is located south of Elbow Canyon Road and west of Littlefield Drive,
south of Littlefield, Arizona. The site is accessed from Elbow Canyon Road via south on the extension of
Littlefield Drive to the site. The site is on the west side of the extension of Littlefield Drive, about one-
eighth of a mile south of Elbow Canyon Road. The property has a residence on it. The terrain is relatively
flat, sloping slightly toward the north and the Virgin River. The surrounding land uses consist of vacant land
and a few scattered residences. There are no significant drainage patterns crossing the property, and
WHEREAS, the applicant proposes this zone change to allow a non-commercial guest house on
their property. The Mohave County General Plan designates this area as a Rural Development Area, and
WHEREAS, a review ofFEMA FIRM Panel #040058-0200B indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and the effect on the property complies with the Mohave County
General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The neighboring area contains other like land uses similar to the above proposed action.
e. The site has legal access.
f. There are no significant environmental features affecting the site.

WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
October 11, 1995, the Commission recommended DENIAL for a Rezone based upon the following:
I. Due to the lack of infrastructure to support the increased density in the area.
2. This constitutes spot zoning and will set a precedence for this area.
3. This will increase the residential density and decrease lot size in the area.
WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County, Arizona, October 22, 1995, and posted October 20, 1995,
as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, November 6,1995, DENIED this Rezone as recommended by the Mohave County Planning
and Zoning Commission and outlined herein.
